    I would also expect the word of a school crossing patrol would (and should) hold far more weight in court much more than any motorist, any quite rightly so. If you don't like it then DON'T BREAK THE LAW - its simple.

    Memorising a registration number - even briefly - hardly requires the mental capacity of an Einstein and would enable the school crossing patrol person to write the number down in a notebook in his pocket 30 or 60 seconds later. All that would be perfectly good from an evidential point of view. If his word was corroborated by another witness (there were others shortly to cross) that would pretty much seal it - provided of course that they came up to snuff during cross-examination if the OP's friend chose to defend the matter at court.

    The current fascination with the need for there to be CCTV evidence at every whip and turn is a fiction created by those weapons of mass distraction we all have in our front rooms - TV. Cogent, honestly presented verbal evidence still counts and people would do well to remember that.

    I've no doubt that thought has been given to installing a video camera in the lollypop/lollipop man's pole but I've yet to hear of one being used. There are far too many imponderables to consider in terms of angle and making allowances for sunlight etc etc.

    And as for the lollipop/lollypop debate both are acceptable forms in English.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    you see, this is the thing - when there are people 20-30 yards away, and the lollipop man is on his way off the road...and someone else has made a complaint, why has the police sent a letter of intention of prosecution on someone's say so? question is, say if i see someone with a set of H.I.D lights or something (As an example) and inform the police, will they send out a letter of intention of prosecution?

    what do these letters mean exactly? - are they suggesting they're about to send you a fine / ticket or does it mean something more serious or less serious.

    The police should throw the book at your friend! I hate drivers who think they own the road and to hell with little kiddies crossing the road!
    I have lost count of the number of times cars have ignored our lollipop man and my son nearly being knocked down!!:mad:
    I have even taken the reg plates of such drivers and reported them to the police - I have even called a white van man's employer and reported him! I then telephoned the local paper to report the problem and asked them to do a feature on it - they did and now there are calming measures all along that road now - Power to the People at last!!

    The law requires that in the case of certain offences - e.g. speeding, driving without due care and attention, failing to obey certain road signs, etc - that a letter warning the driver/registered keeper that they are considering prosecution is sent within 14 days of the alleged offence. They do not actually need any evidence at the time that such a letter is sent, an allegation alone would suffice. Nor is there is any legal guarantee that a prosecution, or indeed the issue of a fixed penalty ticket, will follow although the number of cases that proceed further is greater than the proportion that do not. The letter is simply intended to give someone a "heads up".

    Which is it ? was the lollipop man standing in the road and not moving or was he on his way off the road ?

    I cant believe you are even defending this ! Its the safety of children that your friend has compromised - who reported him and why the police have acted upon it are by the by.

    @mishkanorman - I have no idea...He himself is confused about the situation, but please don't get me wrong... I don't condone dangerous driving and dangerous behaviour. If it were down to me, I'd impose heavy fines on anybody that endangers others lives on the road due to their impatience..The one thing that ticks me off more than anything is people that talk on their phones whilst driving.

    I just happen to know that my friend isn't the kind of person that would drive like that willingly knowing... That's why it was a bit of a surprise to myself as well as to him.

    So after 3 pages of posts it turns out that the defendant is completely fogged as to whether the lollipop man was still standing in the road when he drove through my Lord.

    If the LP man was on his way to the pavement, then why did your pal mention the people 20-30yds away coming to cross the road? They would be irrelevant as they would not be part of the LP man's concern when leaving the road.
    Sounds like the story is changing to a more palatable (if potentially false) version of events.

    Nah, doesn't work. Guilty as charged. :cool:
