    Every right, if the road was clear like you say. If I were a lollipop man, I'd much rather stand in a clear road than a busy one.

    they're presumably fairly under-qualified individuals that aren't as trained as the Police or whatever?
    You have a point insomuch as their timing may not always be perfect and their display of the sign may at times be somewhat ambiguous. This comes down to their training and ongoing supervision and development.

    This does not, however, place any less weight on their testimony in a magistrates court that the driver in question simply put their vehicle in motion in contravention of the sign while it continued to be exhibited.

    Thanks for all your replies.

    Though i don't appreciate some of the cocky posts...I can understand what you mean about road safety near schools etc...

    I've shown this to the driver...But the new development is that the crossing patrol /lollipop man did not report him, someone else did...The police spoke to the lollipop man who doesn't recall of any incidents and this went in favour of the driver, police closed the case and won't be prosecuting.

    All the confusion was because of the letter the Police sent, which was just an 'intention of prosecution' but had no details of the case itself or who reported it etc... But what I'm now intrigued about is, can I just go off and tell the Police I saw someone driving irrationally (in my opinion) and they send a letter to the driver?

    I was involved in a similar incident recently, I use a lollipop man crossing every morning which is always very busy, on this particular day there were roadworks and traffic control lights at the crossing point and also a 200 yards up the road making a chicane. The lollipop man was crossing with the red light on the lane nearest him as the traffic was building up and he was trying to keep the flow. Anyway, lights changed to red, car stopped and he stepped out - at this point my kids used to run across with him - Ive got them out of that bad habit but many others still do this. The car BEHIND the one at the front of the queue decided he didnt want to stop so overtook the first car and sped through the now very red light, missing the lollipop man who turned back as I shouted stop. The driver didnt react at all, and in fact was still accelerating at this point, if any kids had been running across they would have been hit without doubt. I made a complaint to the company whose van it was, they assured me that the driver would be spoken to but i didnt call the police. (still kick myself about that)

    In the case of the OP, I can see why someone has put in a complaint, the kids may be 20 yards up the road but they will just see a chance to cross and go for it. The OP's friend is clearly not as innocent as he protests, he remembers the incident yet to the Lollipop man it was just another impatient idiot who couldnt be bothered to wait !

    afaik the new lollipops have cameras in them which can be operated by the crosser.

    I'm sure I was told some time ago, that the black line across the centre of the lolly was done in blackboard paint and the lollipop lady or man carries chalk in their pocket to note down the number of any driver who violates the rules.

    Any person who disregards a school crossing patrol should get an instant ban for a set period of time IMHO as said person is clearly not responsible enough to be in charge of a machine that could so easily kill or injure another person.
