So, he received a letter which is an "Intention for prosecution" for the offence:
"Drive without due care and attention" --- "Failing to comply with school crossing patrol"

I initially thought that the lollipop man was standing in the middle of the road with the stop sign held up, but apparently, this is not the case and that as far as he recalls, the patrol officer crossed a few people, then put down his lollipop under his arms, but was still standing in the road and that the nearest people were around 20-30 yards away approaching the road, but driver just drove as there was no one in the roads apart from the crossing patrol who was not crossing anyone nor did he have the lollipop 'STOP' sign up.

The driver has two kids that he takes to school and is well recognised for community work in the local area - so basically has good moral character, and for those that keep sending cocky remarks, - No, I was NOT the driver, as a matter of fact I rarely even drive anywhere except the supermarket, and if you don't like the post then don't comment and start getting all personal and insultng. - (MSE RULES!)

Thank you for your reply antrobus and the other posters who decided to not judge, but provide a decent response instead of cocky messages , I'm sure you guys are the most PERFECT god-sent drivers ever.

    Simple fact:-

If you drive "around" a pedestrian and are seen by mr plod, you'll probably get a ticking off.
Do it "around" a lollipop man and you'll get what he's got.

Doesn't matter how many kids he's got, or what a supposed "pillar of the community" he thinks he is, he's a bad driver who doesn't know the highway code, or indeed how to behave with a car.

just because you don't like the advice, doesn't make it wrong.

Not meaning to sound rude but it does sound a bit reckless to keep driving when anybody is in the road near a school, especially a lollipop man. I expect a court would take the side of the lollipop man as his job is to safeguard people crossing near the school, I dread to think what would have happened if one of those people approaching decided to run and start crossing as your friend was driving.
I'm not a perfect driver by any means, however I do try to be extra vigilant near schools and in built up areas.

What would it have cost him/her to wait for a moment or two more? .....literally a moment or two of time that's all!! I don't understand why some people are so impatient when they get behind the wheel of their car...being a little courteous also doesn't cost anything and in this case why would you expect to continue driving when anyone was still standing there? Tell your friend to pay the fine and be thankful that's all their paying and maybe it will teach them a lesson to be a better driver and more patient in the future especially around schools etc!!

In the first instance, he should return the S172 request to provide the details of the driver within the 28 days allowed. He will then more than likely be invited to his local police station for an informal chat, before they decide whether to proceed with an allegation.

As he's now facing a DWDCAA charge, I suggest he comes over here for more detailed advice;-

as he's facing the possibility of a large fine and a good few points.

Given the story, the best result here may well be the offer of a Driver Improvement Course, if one is offered in his area.

I'm good friends with our lollipop lady, and have seen many stupid impatient drivers putting lives at risk. I for one am glad that at least one of them is getting their come-uppance. I just hope that the police proceed with the prosecution.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Idle aside: Do you think OP continues to write "lollypop" instead of lollipop to irritate? ;)

Two issues - was the sign withdrawn (sounds like it), at what point did he drive on.

If he drove on impatiently when the man was still there, he could be seen as driving without due care.

If the man was almost back on pavement, probably not.

    From the OP
He states that the lollypop man had crossed a few people and the road was clear, but the lollypop man was not moving out of the way but waiting for people

From their own description the man was still standing in the traffic lane.
