They have that right as conferred by the law. As was posted above, it's section 28 Road Traffic Regulation Act 1984.There is a huge comparison between traffic lights and lollypop people to whoever compared the two earlier on.
No, there isn't. Both are governed by similar Acts of Parliament. If anything the scholar crossing is more serious as the chances of killing a child by disregarding the stop signal is exponentially higher than at a red light.Have you people considered that this may be a case of an unfair ticket? I don't know if it's a fixed penalty notice or a court appearance, all I was told is what I mentioned in the post...I never drive at school areas to even know what lollypop patrols are like or what they do...But what I'm wondering about is the fact that, fair enough if the police observe and report something (Such as someone using a mobile phone and driving and get an automatic ticket/fine/points for it) but , not to patronise lollypop patrols but they're presumably fairly under-qualified individuals that aren't as trained as the Police or whatever?

Albeit one who seems unable to grasp the fairly basic concept understood by infant children across the country that 'the cars stop when the man holds up his big lollipop'.

Quite possibly none whatsoever, but SFW. The bit I'm missing is what exactly did your friend do when he came across a Lollypop man standing in the middle of the road? The implication is (on the basis that said friend is now in receipt of a ticket) that he carried on driving but managed to avoid running over the Lollypop man.
Full marks for avoiding a charge of vehicular manslaughter, but when you come across someone standing in the middle of the road, it's generally a good idea to bring your car to a stop, irrespective of whether or not the individual impeding your progress is actually carrying a big yellow sign.0 -

Have you people considered that this may be a case of an unfair ticket? You say the driver carried on, presumably past the Lollipopman stoood in the road - then No, it's not an unfair ticket anymore than going through a red light when you can see for 200 yds that there is no other traffic in the vicinity of the junction.

2. If you don't know the rules of the road then you should not be driving.

It seems they are better trained than YOU; you do not know anything of the highway code
You need to:-
1. Accept the fine / whatever comes your way and accept that you need to improve your knowledge of the highway code.
Or
2. Argue your case with the magistrates. That way you'll get a period to reflect on your errors whilst sitting on buses.

I have just got more information from him...
So, he received a letter which is an "Intention for prosecution" for the offence:
"Drive without due care and attention" --- "Failing to comply with school crossing patrol"
I initially thought that the lollipop man was standing in the middle of the road with the stop sign held up, but apparently, this is not the case and that as far as he recalls, the patrol officer crossed a few people, then put down his lollipop under his arms, but was still standing in the road and that the nearest people were around 20-30 yards away approaching the road, but driver just drove as there was no one in the roads apart from the crossing patrol who was not crossing anyone nor did he have the lollipop 'STOP' sign up.
The driver has two kids that he takes to school and is well recognised for community work in the local area - so basically has good moral character, and for those that keep sending cocky remarks, - No, I was NOT the driver, as a matter of fact I rarely even drive anywhere except the supermarket, and if you don't like the post then don't comment and start getting all personal and insultng. - (MSE RULES!)
