It's absoultely shocking that not only is there a fair amount of people saying it's ok but they are actively defending companies trying to siphon off more of your consumer rights using this license business as an excuse.

And what about the company's rights? They have sold a single use license, that's like me complaining that Kodak are 'siphoning off' my consumer rights because I chose to buy a pre-used single use camera, which, due to already being used, was useless to me hen it arrived. No-one is forcing people to buy these products, so stop complaining and buy non single-use games *facepalm*

Really not sure that has taken the debate any further.

    Blimey, another one. :wall:

You mean, not another person that actually understands the law of contracts? Rather than the law of what I would like to be the case?

    Why.....have you seen one?

Hmm, yes quite a few on this thread for example - the ones that point out that there is nothing illegal or unfair in selling a licence to use a product rather than the product itself.

Please point to where I have referenced anything about buying or selling software?

How many more times do I have to write it? Just because something is in the terms and conditions, doesn't automatically make it enforceable.

Then your posts are not relevant to the OP, and are therefore taking the thread off topic.

You don't need to, as I think you have already stated this a number of times. ;)

You need to get a refund from the seller as the game you bought has technical restrictions in place (DRM?) to prevent the reselling of it.

In that case perhaps you should stick to the question asked by the op - as others have done.

The original purchaser of the software agreed to the terms and conditions, the original seller should not have sold the software on to the op, so the op should go back to his vendor and ask for a refund.

Oh, sorry, think I might have said that before. This need to repeat is catching.

Shoot me down if I am wrong or it has been said before but doesn't the Sale of Goods act's implied terms state that the seller must be authorised to sell the goods? And does this not apply to private sellers too?

So can't the OP get their money back from the seller?
