I hear what your saying Taffy and your situation would have been extremely unfortunate, but is no insurance not one of those absolute offences, you either have it or you don't? So therefore guilty or not guilty.
In your case your mitigation would just lead to admonishment or lesser punishment.
For the owner of the vehicle yes, the only defence in law would be if your employer had not renewed/had a company policy cancelled and you were driving as an employee in the belief the vehicle was insured.0 -
Well it's beside the point now as it was three years ago
but in regards to the friend of the OP think she will get banned unless the judge is lenient
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -

The law states that it is the driver's responsibility to ensure that adequate insurance cover is in place for the vehicle being driven, end of story. Having said that, the police should not of allowed her to continue to drive without confirming the insurance status. I believe that is the current proceedure. What would of happened had she had an accident resulting in serious injury (or worse) AFTER the police had let her carry on?PLEASE NOTEMy advice should be used as guidance only. In such circumstances, had she carried on then she would have remained uninsured. Whether the police may have had some culpability would turn on the unknown facts of the individual case.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

It's not the fact I got away with it, just pointing out that sometimes it's not entirely your fault you are not insured, in my case I paid for my insurance in full for the year, I gave them full details of my existing insurance including policy number and sent them a copy of my no claims as soon as I got it, they then claimed that they never received it, funny that as it was sent recorded, also they didn't write to me but sent an email and the payment back to my card was not received until complained, so if I was stopped who's fault is it ?
Unfortunately, it seems it's common practice to insure a car on monthly payments, tax the car, then stop paying the installments.
How are people suppose to know whether your error was innocent or not?
The insurance company CERTAINLY fell down not sending you a cancellation by post, but by email. Funny you never received it.0 -

Told you I changed ISP around that time, so the email address I was using no longer worked, but they should have known that as it would have bounced back to them.
