It must say who is offering the guarantee. So who is it?

Hi,
Just a quick question.
I bought an item from an independent UK store online and as the order was £75, I qualified for free delivery. When the item arrived it didn't fit me so I paid to return it requesting a refund.
A couple of days later I received an email saying I have been given a partial refund as they have taken £2.99 to cover the original outbound postage from their end.
Are they entitled to do this, or should I receive 100% of the £75 I paid?
Thanks in advance!0 -

No they are not, you are entitled to the full £75.

Thanks Derrick. I thought that was the case I just wanted to check first.
They aren't willing to provide the full refund at the minute as they're saying they need to cover their costs. I've replied stating that while I understand the fact that they don't want to lose money, this still goes against Consumer rights.
Any advice on what I can do if they still refuse?0 -

How did you pay for it? If by card, try a chargeback. The bank may reject it as chargeback typically only covers breach of contract situations but you can try arguing that the legislation forms part of the contract (especially since most provisions in it expressly state that the contract is to be treated as including them as a term).
But I'd also point out its £2.99. Any time you'd have to spend to try recover this sum is most likely going to outweigh the value involved. A report to trading standards, bad review warning others & voting with your feet (and purse/wallet) would be more appropriate? You keep using that word. Hi
I bought a sofa from perfect home ( only because they were my only option ) on hire purchase. After 10 months the sofa was faulty. They admitted the sofa was faulty and took the sofa back and transfered £700 balance to a new agreement on a different sofa. After a few months this sofa was faulty. They sent sofa experts out who said it was a design fault in the sofa and perfect home accepted blame. They sent out a replacement sofa and the same happened again and the sofa expert came out again. He said it will keep happening and the build quality of their sofas are to blame. Perfect home again accepted blame... at this point we were not willing to accept a 4th sofa and requested our money back. Perfect home offered to give a full refund on the 2nd agreement but would not refund any of the £700 on the 1st agreement. We refused this and took it to the ombudman. They have contacted perfect home and they have offered 50% of the whole agreement paid back. £600 approx. We asked for a 50% refund on the 1st agreement and 100% on the 2nd £900 approx
Perfect home have refused this and the ombusman says we are lucky to be offered this.
What should we do.?? Is this a fair offer?? Is it worth going to court??
Please help have to reply in the next few days0 -

Thanks for the response. The company has now refunded the postage.
It was only £2.99 but it was more a matter of principle.0 -

I bought a power supply (electronic item) and when I switched it on it appeared to have multiple faults, including audible shorts.
I foolishly tore up the box before checking that it was working OK.
The retailer's terms and conditions say that both faulty goods and general returns need to be sent back with original packaging in pristine condition, otherwise they will reduce the refund amount to compensate them for not having the original box.
What are the rules on this under current consumer rights legislation? If your item is faulty are you entitled to a full refund even if you don't send it back in the original box?
I could only find old posts on this and Which talks about the importance of returning goods with packaging, but I got the sense this was to make things easier.0
