  • OMG - Thanks for posting this. We received letter today exactly the same and a total shock and suprise...we will also get our credit file now and watch out for anything further. Thanks again.
  • Hi Sara,
I've had the same letter last month and now a second and phone calls from this company. They said my account was opened 12 years ago and I owe them £46.00 however they got really rude on the phone telling me that my disbelief at their phone call was not an excuse not to take action before it went on my credit score !! I asked them to send me a signed copy of my agreement with Littlewoods or whoever and prove my payment history. They said they woudl get back to me once they have collected all the paperwork. I will wait and see what happens .. however I have also sent the "prove it" letter to them so thanks for posting this up and the replies are very helpful.

Eggflipper - if it's 12 years ago and this is the first you're hearing about it, it's statutory barred anyway. Sounds like they bought a load of debts cheaply and are now going fishing.

I was going to say something similar...

The only thing extra I was going to ask was when they claim this debt was actually from and last paid towards?

The account they claim may have been opened 12 years ago, but whether the debt is statute barred depends on when the debt was accrued on the account or last paid/acknowledged.

Not withstanding the issue of whether it is yours in the first place that is..

  • I too received the exact same letter on the same day saying I owe £49.41. I rang Littlewoods to check if I had any debt with them and they checked their computers and said nothing was showing up. They even said it would show up if a debt had been sold on. Then I received a phone call from them yesterday telling me it was to do with an account from 1993 to 2000. I told them I had already contacted Littlewoods about this and denied any debt. He seemed surprised. I rang Littlewoods again for peace of mind who put me through to their arrears department who again found no record of debt. She even laughed when I told her it was from 2000. I am now writing to them with the letter and saying I have rung twice so they need to provide proof.

  • I have received the same letter with same date and same reference number as others. The letter is a photocopy. Reading on other sites people seem to be getting these letters for no reason and think maybe it is scam.

They left me a phone message and when I tried to call the 0333 number back no one answered after 5 mins. Hope the charges were not too much a minute to this number.

Tonight they called at 8.20pm asking me to identify myself. They demanded payment of £748 for a Littlewoods debt from 1998. I informed them that I do not recall a debt from 1998. They became incredible rude saying they would send an agent to my door. I asked them to send proof that this was my debt, they said they would get the paperwork together and send me.

I have checked my credit reference file and so far everything is far and in good order.

As I know a little bit about debt I informed that if the debt was over 6 years old it was classed as statute barred. They said they could not take me to Court after 6 years but it did not stop them telephoning and sending agents to my door to demand payment.

I informed them that I found this threatening especially as I do not recall the debt and I have seen no proof it is my debt. they told me they would telephone up to 3 times a day until a paid and send agents to my door. I told them that this was on the verge of harrassment and I would report them to Trading Standards, I was told to go ahead then as legally a debt collection agency could telephone up to 3 times a day and send agents until the debt is paid.

Does anyone know if this is correct? I'm fed up with the calls already especially when they ring when my 3 yr old to bed.

    Ta

    OFT Debt Collection Guidance

Loads of breaches of guidance here, including

    k. not ceasing collection activity whilst investigating a reasonably queried or disputed debt.

Fermi has a useful letter here:

which I think I'd send, then report them to all and sundry if they do not back off or prove the debt and your acknowledgement of it within the past six years.
