He says it's already in his name but at the finance co's address, so he doesn't need to change the name, only the address.

And if its in the finance Companies address, how do you expect the OP to get hold of the document...?!

Any reason why he couldn't complete a V62 to request a replacement certificate be sent to his "new address"?

Infact, did you not read the first few lines of this thread...?!
the finance company they arranged the funding through have insisted that they will keep the V5 registration document until I have completed all payments on the vehicle

I recently purchased a 2nd hand car through a main dealer, the finance company they arranged the funding through have insisted that they will keep the V5 registration document until I have completed all payments on the vehicle.
I queried the validity of this with the (very reputable) main dealer who said that it was not uncommon but did not happen in every case and not to worry about it, it depended on the individual finance company.
I have since spoken to the finance company, and the car is registered in my name to their address, and anything relevant that gets sent to them (road tax renewal, fines etc etc) will go to them and then be forwarded to me.
Can anyone advise me on the validity of doing this? I know the car is legally theirs until the final payment but this is the first time I have ever heard of this happening.

    thanks in advance

    R

Is the car leased, or is it on hire purchase?

Yes, read my earlier post in this thread...

There is nothing stopping the OP completing a V62 and putting his "new" address on the form. The DVLA would have no reason to contact the finance compnay.

You seem to be missing my point by a country mile.

The OP does not need the original certificate. The car is in the OP's name but at the finance company's address.

He can complete a V62 to request a replacement certificate and, at the same time, record his change of address. The car is already in his name, so there is no change of keeper.

    OMG are you thick...?!

OK, so the OP fills out a V62...

The DVLA will then write to the current reg'd keeper (which is the OP at the Finance Co address...) telling them that someone is wanting to put the car in their name/address. The finance co will open the mail (as it is in thier address and are allowed to by law) and then write back to the DVLA DECLINING the change of ownership.

    Jesus...
  • When you move house and tell DVLA of the change of address, they don't write to you at your old address to confirm the change first do they.

No, cos thats just a simple change of address which is done by filling in the Reg Cert which you will have in your posession.

The OP doesnt have the Doc in their posession do they? So how will they fill in the doc to tell the DVLA they have moved...?

    Just to clarify:

To change your name (if you get married, divorced etc) is done by filling out the Registration Certificate which you have in your possession.

To change your address for when you move house is done by the same way.

If you dont have a doc in you posession (like the OP) then they only way to get one is to apply using a V62...

If the OP fills this out in thier name at their address, the DVLA will write to the reg'd keeper (which is the OP, but at the finance co address) to notify them that someone is wanting to register the car in a different name. The current reg'd keeper (finance co) then has 14 days (from memory) to respond to this letter. If they fail to respond then the DVLA will then issue a ew Reg Cert in the name/address supplied on the V62.

So what is there to stop my neighbour filling out a V62 in my name but at their address...?!
