Parking Eye Court Action

Ok so maybe not a full transcript ..but surely either party is entitled to a summary of the judgement ..we've seen them posted here before.
You would think so, a brief outline of the judgement and the reasoning for it.
Seen a few posted transcripts about too, so there may be a cheaper option somehow!0 -

So this wasn't in their court bundle? Did they just wave it about in the room, or did you get to read it?0 -

The judge made them hand it over to me for me to read and then asked if I was happy with it and happy to continue. It wasn't in the bundle, she seemed really pleased with herself that they had pulled it out when I asked for it!0 -
In theory it could have been ruled inadmissible as it wasn't in their bundle. You would also have been in your rights to ask for an adjournment so that you were able to examine the document or obtain legal advice. You shouldn't have been put in the position where you had to examine it with 5 pairs of eyes staring at you.
Actually, even now we should be able to request a copy and go back to the judge if this was refused.
Of course, it's easier to pay the £15, but if you had a wodge of money and enough time on your hands you could drag it out even longer by setting the judgment aside and appealing costs etc.
But overall, i think it just demonstrates that Pannone are rather incompetent.0 -
I have been a regular viewer of these pages for some time but not really felt the need to post until now. If I should start a new thread I will be happy to but I'm keen to get some advice from Smithy. I saw the negative posts towards him at the beginning and expect the same reaction as I have not posted before but I am genuinely worried.
I parked at the same car park as Smithy and like him didn't realise it was a P&D car park as I don't live in Manchester and when I visited previously a ticket was issued upon entry and as the barriers were up on this occasion I thought I got lucky. I too was visiting BPP and I had originally parked for the morning in the NCP car park on Chorlton St however the pricing was really expensive so I moved my car at lunchtime as I was late for my course so didn't have time to mess around when I arrived.
Basically, I have ignored three letters from PE and I have ignored a letter from Roxburghe. I have now received a letter from Graham White Solicitors issuing a notice of intended litigation. The total they want now is £177 plus if they pursue the litigation they want another £207 (I will upload the letter if I need to?). The letter is dated 2nd Dec but only arrived in the last few days. I was hoping they may let it go following Smithy's success but it seems not.
I really don't want to pay them a penny, but should I maybe offer a £10 contribution to cover their 'loss' as if it goes to court this will go in my favour?
Appreciate any help, thanks..0 -
That "notice of intended litigation" is just their usual meaningless and hollow threatogram. "Graham White won't go near any court. They have tried it twice. Once they didn't turn up and the other time they made a mess of the paperwork. Just keep ignoring these clownsWhat part of "A whop bop-a-lu a whop bam boo" don't you understand?0

What Roxburgh & Graham White have sent you letters re Parking Eye charges ???
Nothing from Pannone ?0 -
Thanks for the reply Trisontana... Just a bit nerve wracking seeing the letters rack up...
Sirdan, no nothing from Pannone? 3 letters from PE with escalating charges, one letter from Roxburghe which is very similar to an example posted recently under another thread which happens to mention they are aware of the 'anecdotal advice on the Internet' which amused me at the time but slight more concerned with the Graham Whitt letter, who are acting for Roxburghe.
I am not going to pay but wondered I'd I should offer a token amount as had Smithy offered something early on his costs would have been less. I figure the minimum they want from me now is £177.. So even if I am forced to pay the same as Smithy then it's still less than now plus they'll have to fork out huge costs...
The letter is dated 2nd and I had 7 days to respond but it only came in the last couple of days so any deadline has now passed. Not sure what to expect next but I want to be prepared!!0 -

Let's gets one thing absolutely clear for you here :-
This "Graham White Solicitors" as a genuine firm of Solicitors DO NOT EXIST
The letters come from Roxburgh, their address, their phone number etc etc.
"Graham White " is a trading name used by Michael Sobell a one man band Solicitor who allows Roxburgh to use his name .
I've had his letters before (several times) and there has never been anything else..you will get a final warning ..and then NOTHING.
If Parking Eye were to instruct Solicitors to act for real they certainly would NOT use this Roxburgh stooge.
Remember only Parking Eye can take action against you NOT Roxburgh ..Roxburgh do not own this "alleged debt" and have no powers to act against you,all they can do is to refer it back to Parking Eye.
You could if you wish hedge your bets as it were and send them a cheque for the P&D charge that you didn't pay ..make sure you make it very clear that it is offered as "full and final settlement" ..send recorded and keep a copy of the letter and the cheque" .0 -
