Are Cap 1 still accepting your payments its a long thread so i cant remember what you said
What Wescot say is the grey area between fact and fiction Cap 1 should tell you who is collecting the debt but knowing them they wont bother all I can say is (what a good person said to me) you are building up a complaint to the OFT if they do take you to court what are they going to say we need a CCJ because inamessman is confused has who to pay because we did not tell him with a correct NOA who owned the debt
we took his money direct but did not tell him Wescot would be collecting for us and we also let Wescot harrass the hell out of this poor guy
so my Lord would you force him to pay the full amount now and put a charging order on his house attach the debt to his earnings and make him eat cold beans for the rest of his life because we want our money that he is already paying us back (what you can afford)

either just pay Westcot on your DMP or write to them and ask for a notice of assignment. Its a normal procedure that they pass debts to a DCA after a period of time. it will make no difference to your DMP who you are paying, CCCS and Payplan change payees all the time. They are all muppets but you shouldn't let the muppetry get to you, if you are on the DMP, play the game and get it paid. its an enforceable debt so other than offering a full and final you have no other options. i just like to now were i stand i dont want to be paying westcot every month and then capital one come back to me in a year and say i have never paid them

This is still confusing, because if Wescot DO own the debt, you don't want to be paying c1.
You really do need positive clarification of who actually owns it.
I would be asking for copies of the noa's.

Chippy is right you need to know whats happening but CAP1 are very bad at supplying info so it wont be easy
What they do and what the OFT say they should be doing are two totally different things
Have you got a letter from Wescot that says we are collecting for CAP1 or does it say we have acquired the debt they cant just write demanding you pay them they could be anyone
I have just got one from Lowells it states its a NOA but its a photo copy and looks dodgy I have a dispute with this debt but it never stops it from been passed around DCA0 -
just a letter from westcot saying they are collecting doesnt mention that capital one have passed on the debt
they really are a joke they just ignore all letters surely not a way for a big company to run0 -
on a seperate note i am traying to get a list of charges from capital one
they have twice replied saying my signature doesnt match, now considering this exactly matches the signature on my cca they have sent me how does this make any sense?0 -
