    Have been in touch with the court, then the solicitors who put it through, now the ministers are going to call me back.

    But it's my student loan. I thought that came off when I earnt more than £15k!

    Did you get any paperwork for the CCJ?

    How old is the Student loan? When was last time you paid it?
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    No, they are going to send me out a standing order mandate.

    A few years, maybe 3? I have never paid it because I've never earned more than £15k which I thought was how it worked. Guess I was wrong! Although apparently I set up a payment plan then never paid it. I just want rid of it now but that is a lot of money and apparently with court costs it's actually 2.8k

    The thing is its Scotland nad I dont have a clue of terminologhy there. But if you never received court papers I would expect that you could set aside the judgement as you can in the UK.

    I wouldent of thought that SLC can take you to court as you are not earning over 15k, but then again I might be wrong.

    I assume that the student loan was one of old mortgage style loans such as the ones I have? Certainly sounds like it?

    If so, then you can't just ignore it and assume that you don't have to pay if you are earning under the £15 threshold.

    Each year you need to fill out a deferment application with proof of income.

    If you don't formally defer, then you are liable under the agreement to make repayments. If you don't make them, then arrears will build up.

    SLC can backdate any deferment by up to 3 months, but if you have more than that in arrears then they are due and payable and you can be taken to court for non-payment of them..

    I know. I've got some arrears like that. :o

    I guess its quite likely that court papers would have been sent to an old address. Unless Drea told the SLC about each address change then its quite possible court papers were sent.

    Certainly in the UK you cannot get them set aside if you didn't keep them up to date with your addresses.

    SLC coudl take someome to to court for repayment of SLC if they didn't complete the deferment forms (assuming old style loans).

    Thanks everyone, looks like my credit rating is shot for the foreseeable future. I'm out of work at the moment so can't pay much back so it will take forever to clear the debt. I almost feel better though, just knowing what it's for.
