Phones4U - T-Mobile package (problem)

Hi All

I will try and keep it short. I was on O2 for over 10 years. Came away last week as I was not receiving any service from them in my area. I moved over to T-Mobile via a handset contract with Phones4U. . . .

£25 per month (24 month contract)
HTC Desire HD
600 mins calls (all networks + landlines)
500 texts (all networks)
Internet

While in store, before I agreed and signed anything, I made sure that the sales guy showed me that my area/postcode was good for services with T-Mobile/Orange and internet (baring in mind what had happened with O2 services). He showed me onscreen which stated it was 'good" to 'very good'. However, apart from a issue with the handset which is either a battery problem or a handset problem as the battery drains very quickly, an issue has been brought up with me via T-Mobile during a call I made to them today.

I have been having issues with trying to use the mobile internet. I mentioned it to T-Mobile who have informed me that with my postcoded area, mobile internet is "non-existant". This concerns me as I am in a brand new 24 month contract with T-Mobile, new handset, and I use the internet alot on my mobile device (due to disability and not leaving home that much), and using it to browse and download, etc. I feel cheated by Phones4U as I guess I have been mis-sold this package.

Can anyone advise on what steps/action I can take?

    Thanks. Taking it to the shop is the easy bit, but what grounds do I have? Mis-sold?

    I think so. Quote what T-mobile told you and ask them to phone T-mobile if they want to check this.

    I'd try to phone to the shop first.

    As I had and signed the agreement on the 8th March, and with the store telling me that they no longer do anything such as a "cooling off period", is it possible to cancel the agreement?

    I cannot use T-Mobile due to the above problems, or would Phones4U suggest another provider and continue the contract set to another provider?

    Sorry, I am new to contract phones.

    There is no cooling off period, but they missold you. I'd expect them to be and hostile defensive. You stick to your guns. Have a read of Martin's guide: Consumer Rights. Pay attention to SAD: sadfart3.gif

    Just had a look at the small print on my agreement and it says under (Refunds & Exchanges):

    "contract handsets may be refunded within 14 days of the date of sale if the network coverage is considered to be poor at the customers contractual address and no alternative network agreement can be established. Cancellation is subject to network provider approval"

    Good news!

    Having said that, at home it is a norm to connect to the internet via WiFi if your router is wireless. It is better, faster and doesn't cost you anything.

    I'm just reading through the useful link, thank you Grumbler for that. I rang Phones4U and they said to come back to the store and they will see what they can do. That's good, but I will be aware if they try and pull the wool over my eyes, so to speak. So reading that guide will be very handy.

    There are some things you should consider:

    What did the T-Mobile person mean by the mobile internet signal begin non-existent? Its the same signal as used for voice and texts. So how many bars does your handset show? Are you receiving 3G, is it turned on in your settings?

    Is your handset all set up for data? It would be embarrassing to return to phones for you, only to find your settings are incorrect or you've turned off data.
