    We're probably at cross purposes there? The Code 559L you mentioned I assumed to be 09-10? The deductions on there are too low ..... but have you checked if they get close to the figures on your 08-09 P11D?

    Sorry .... the P11d fig for 2008 shows 717/ 2009 shows 1458 and 2010 2624

    I seem to be being a bit thick here but your advice is really helping.

    As I said in post #40 ....... these things tend to work a year in arrears. As that's how they start out - with the first P11D typically getting to HMRC in the July following the end of the tax year in which the benefit first starts.

    The figure above looks to be much closer to the deductions in the 09-10 Coding? You need to cross reference them - but contact HMRC if they won't tally?
    If you want to test the depth of the water .........don't use both feet !

    Yes I can see that , however the 2008 fig was not used on my coding... If they are trying to catch up that year too should i be able to challenge... Will contact them but would like your view Thanks

    Unlikely as 08-09 and 09-10 P800s tend to be issued together. Can only suggest you get out all P11Ds and try to cross match them to your P2 (Coding Notices).
    If that fails then ask HMRC to look at the entity

    The Low Income Tax Reforms Group (LITRG) has a guide to help at www.litrg.org.uk/news/2011/2007-08-paye-under
    They reckon most should be able to resist HMRC particularly as the P800 assessment is so old - almost 3 years.

    It gives guidance on how to go about dealing with HMRC.

    This is massively incorrect advice. I presume they're trying to rely on the ESC A19 timeframes. This only applies where information supplied by employers or taxpayers has not been used to update a tax code within 12 months of the end of the tax year in which the information was received.

    Just as people have the right to request repayments of tax going back 6 years (although these timescales are changing), so do HMRC have the right to collect any underpaid tax for the same period.
