At the end of the day it's up to you but I personally would take it if they were offering all your charges back as you are getting back all that you have 'paid out'.0

I agree.... if you have all the charges back, that's surely "JOB DONE". :beer:
Although you would get interest if you went through to the court process, i think most people would use "interest" as a bargaining tool to get the claim sorted asap, and you HAVE GOT FULL OFFER without the hassle of court.

I am claiming approx £5000 for my son and First Direct have said NO,, I think they seem to have a limit at which they are paying out without a fight,so its on to the courts,,,,0

Hi there, this is my first claim (one of 9 I am doing). I calculated charges at £845.00 and claimed with interest £985. Received a letter from FD offering £714.00 to be paid to Metropolitian collection Serivces to reduce my outstanding debt (overdraft got bigger, turned it into a loan, defaulted on loan).
I have no problem with having the money paid to MCS at all - as a DFW it's all good..... However, I have nothing to lose in taking this further and going to the courts to request more and interest. It's not as if they are paying me a lump of cash - i won't technically see the money, my debt will be reduced. Therefore I have the time to see this through.

Please don't shout at me Mr / Mrs Moderator.
I have read several threads on here looking for the answer to my question, however, I haven't come across it, maybe it's the way the responses to questions are posted on the forums?? yet it has been asked by many folks on here, I'm just wondering if someone can answer me please?
The question is this:
I have a First Direct account and the wife and I have lots of excess overdraft fees which I know we can claim. But on the same day First Direct also charge us an "Overdraft Fee". Is this also claimable? as this amount seems to change value every month with the direction of wind? sometimes £20 somtimes £30.
Can someone shed some light on wether we can claim this also, or is it just the Excess fees that are claimable?
I know there is also a list of what you can claim and what you can't, but the overdraft fee is not listed on either - please help

I have just rung First Direct to ask for the last 6 years of statements.
I was put on hold for a little while then she came back and said they could do that but she was just checking to see if the new system was in place.
The new system is that they will be able to send out just the charges on the account, you won't have to trawl through all the statements anymore.
Apparently this will be inplace on the 26th July and it will be quicker for them and us then the statement route. I have no reason to doubt this and am not assuming this is a delaying tactic.
So I will ring again on the 26th and ask for all the charges on both my accounts.
Maybe they will make this part easier but start taking all the cases to court, we'll see.
Maybe it was just getting a bit stupid and costly sending out all the statements by courier. Not very green that's for sure.

Can anyone help me here.
I have a dormant first direct account, that had a 1p debit balance for debit interest from years ago. I phoned them and asked to close it and was told NO, you must send us a cheque for 1p and send a letter requesting account closure. I thought stuff that they can carry on sending me statements every month costing them money.
Well today I got a odd letter from them saying I now owe them £45.63 from interest and charges. There are also 2 lovefilm Direct debits which I dont really understand, but they may be using very very old details when i did use the account. I took up a come back offer from them.
They say they wrote to me and therefore they can do what they like. I am just a bad boy for not maintaining my account properly.
Does this qualify for illegal bank chages. How do I reclaim them. Do I pay it off so it stops and fight for its return. I would rather waste £30 than lets these crooks steal from me.
I dont have the statements will all the details as i just binned them each month without ever opening them.

Ask for your copies of statements first. I had this with First Direct and the interest they charged was extortionate - but unfortunately you cannot claim this back. Lovefilm is the company that operate rental dvd/games via a postal service, howeve if you obtain the statements you should see if this was a company you regularly dealt with. Any charges for returned direct debits and overdraft fees can be claimed so hunt through and see what the statements show.0
