    Thanks for your help, I jumped the gun a bit and started court proceedings today, for the full amount, so shall I just ignore their letter ? or do I have to acknowldge it ? I thought it might be simpler to go for the whole lot via the courts.

    At court, you are allowed to claim for the charges+interest (8%)+court fee. Are you not claiming for this? If you are not, just edit the letter to fit your own circumstance. The wording of the letter is a suggestion.

    Yes I am claiming for charges + interest and court fee, but as I have already started court procedings for the full amount, should I accept what they have offered, and press ahead for the remainder, and if so do I need to change the amount I am claiming through the court?.

    Have they paid you this money already or was it an offer in a letter? Either way, you need to write to them with the above letter to let them know what you are doing now.

    They sent me the offer in a letter this morning, I think perhaps I should accept their offer as part settlement and press ahead with court proceedings, the thing that is confusing me is that I have started proceedings for the full amount (2500.00 ) and they have offered me 1450.00, do I just leave the claim through the courts as it is (2500.00), or change it to show the difference between what they have offered and the full claim ie: 1450.00 ?

    Do not adjust your claim in the court. This is only an offer in a letter, you do not have the money in your account and when you tell them you will only accept this as a part payment, they will not pay you this offer.

    The only time you adjust the amount of your claim at court is if you actually get any payment from the bank. You only do this after you receive any money. Not just a letter offering payment of any sort.

  • Amount claimed £2197.00 plus £614.88 interest from FD.

    They were very quick in making an offer but offered only £1800. As I was asking for £2811.88 including the interest I thought a £1000 less seemed unfair but I didn't realise until reading on this site that they do not give interest back and now its been 10 days and I have heared nothing.

    I really feel like I have done the wrong thing now and don't know what to do as I think they are not even going to reply to my letter at all now.
