  • OH is in the process of claiming £3000+ from First Direct. We live in Scotland and looking at the 'standard letters' to go to small claims court, he can only claim for £750 and only from 5 years ago.

    Does this mean that if he gets any offer over £750 he should just take it?

    Hope someone can help us out with this :confused:
  • If it comes to going to court he can put in several claims of £750 each but I would wait and see what happens meantime as for all they know you could be claiming in England.

    Thanks Edinburghlass, that's helpful, i've had a look at the link you gave and if necessary and possible, i'll probably apply to the English courts, I'm in the south of Scotland and the 'border' is not far away, so that is not a problem. I will see what response we get, but if it's anything like most others we'll probably have to do 'the court thing'! :beer:

    Just after a little advice re. First Direct.

    Had an account with them which they closed down about 18 months ago due to me defaulting on a loan and being generally over my overdraft permenantly (caused by their excessive charges...) My account balance was passed to a debt collection agency, who I am still paying at the moment. Am I entitled to claim? If i won I would want them to take the money awarded off the amount I owe and hopefully that would rid me of this financial burden!

    also, if i were to contact them by telephone, could they provide me with my account number? i have lived at 5 addresses in the last 6 years and don't fancy quoting them all in a letter!

    any advice would be greatly appreciated.

  • hi, i know this is going to sound stupid, but what am i actually looking for on the bank statements, they are in front of me, but i dont understand them, ie, what does the letter D mean.

  • I've sent my 'threat of court action' letter, using the second template on this site, and I didn't include interest in the amount I initially submitted to them.

    The 7 days for them to respond are up on Friday and I'm just preparing for starting action if I don't hear from them - and very nervous about it.

    If I have to start a claim through MoneyClaim, can I now add the interest amount on top of my claim? (FYI - this will take the total inc interest to circa £5029 :eek: ).

    Can anyone advise? I have tried to search for info on here but can't seem to find any.

    You need to read Martin's article again and then post 4 in Reclaim Help Thread link in my signature for what you can and can't claim. If you don't know what abbreviations your bank uses for the different charges phone them up and ask.

    You then need to input each charge individually into the Interest Calculator linked to in Martin's article giving a description of each charge and the date and then send this list off to your bank with the first letter template in the article and make at least one copy as you may need this again later.

    The banks won't give an offer including the interest anyway so its no problem not having added it. If you are claiming on MoneyClaim online you then need to input your charges again into the Interest Calculator which will give an up to date interest figure and include that in your claim then.
