Checked MCOL and FD have now put in a defence, so waiting for the AQ. I was hoping they might have made me an offer but no such luck, I'm not whimping out now not much more to do!

I successfully claimed £560 in past bank charges from First Direct back in January 2007 which was really simple to do.
I decided to claim for late charges and overlimit charges for my credit card which I hold with First Direct, this amounted to £210. I sent the first letter and received a reply yesterday from First Direct with them refusing to pay out on these charges because they believe them to be fair and reasonable.
What I want to know is am I right to be claiming back late payment and overlimit charges ?
Do I have a leg to stand on ?
Please help because am now really concerned !0 -

Yes you are right to claim for these on a credit card. I am in the process of doing so with 2 of my credit cards and received the same letter as you from both of them.
Don't worry it's just their standard put off letter. Stick to the step-by-step guide and your timescales and you'll be fine.
When I got the letters from my 2 claims, I was worried also but after some great advice on this site, I carried on with my timescales/letters and have received offers from them now. They wouldn't have made an offer if they really thought their charges were fair and reasonable - they would stick by their guns so don't worry - they are just trying to make you drop your claim.

I sent first letter to First Direct on Monday 19th Feb requesting list of all charges etc... I also sent cheque for £10.
Today recieved a letter from F/D. The letter states that they will arrange to send statements by courier, I will have to sign for them. They also informed me that this will be done free of charge. They have returned my cheque.
Is this normal practice?

Yes, HSBC/FD often seem to waive the fee.0 -

i've been through the lists on the site and i'm not sure if this is a new one? The £35 "overdraft fee" that First Direct charges me. i don't know when this gets charged cos its not always when i've been overdrawn. sometimes i go overdrawn and don't get this charge.
i have successfully claimed the excess overdraft fees (over £1400) from them but i am wondering if the overdraft fee should have been claimed too and if so is it too risky to claim a second time? They did have me sign a piece of paper saying i was happy with the settlement. if i can do it then i could be up for about the same as before.
i can't find any info on the site about these charges. its not the debit interest charge but it goes alongside the excess overdraft fee in the statements, i just ignored them in my claim.
please help.....as you can see i am losing sleep over this

Orignally claim £910.74
offer - 576
They sent me statements and now recieved letter today stating that they wont refund recall fees of £75 included and they say i duplicated one amount of £25 (which i didnt - they just charged me twice that day) and they are taking off £52 previous refund fees bring it down to 758.74
With an offer of 576 this seems a bit rubbish. dont know what to do now. i have an overdraft of 600 and am worried they will close my account down. Anyone?0 -
Hi everyone, have just received settlement letter from FD, on the last day of 14 day dealine, offering the standard 85% of claim. When my account was closed, my personal loan with FD was passed onto Metropolitan collection services and I now pay them direct via an arrangement. In the banks letter they state they will pay the sum offered (£2203) if accepted will be apid straight to Metropolitan. Is this lawful - I understood that this was a separate agreement.
Any advice would be appreciated. I dont want the money to go to MCS. I am paying them an affordable amount, and think the refund of charges could be put to better use paying off some small credit card amounts.0 -
I sent my 'threatening court action' letter using the second template, and I've had my reply today. They've rejected my claim again, point me towards the bank charges set out in their documentation and said I had the right the take it to the financial ombudsman.
It's a standard letter I guess. Starts 'I'm sorry to learn you remain dissatisfied with our letter dated........First Direct does not agree with your contention that the charges applied to your account are unlawful....etc...etc...'
Next step? Do I start a claim through moneyclaim now? God. I'm nervous. What if I lose the claim?0
