My 10 day wait is up and this morning I got a letter telling me that they disagreed and pointed me towards their T&Cs, and that they were refusing to repay my charges.:(
What's the next step? Is this normal? I'm a bit scared for some reason
What's the worst that can happen if I take this forward?
Alisonjs - what letter have you sent ? If it is just the first one go ahead and send the next one. If you have sent all the letters then go ahead now to the court stage...The worst that can happen is that you take them to court and dont win !! Seems to be unlikely though, FD seem to make offers before it gets to court.0 -
Hi newby here.... I've gone through our statements for the last year with First Direct, they've had £385 out of us in charges in that period so my letter goes off today.
Watch this space? I'm a bit unsure as to whether we'll get anything as we have 3 accounts each with an authorised overdraft. The charges relate to us going over the authorised limit but usually by a small amount (£2) for a day for which we get charged £30.
Thanks for the support and words of wisdom here though.Lightbulb date: 11.2.07 :j

Ok I've read the small claims note, if I don't hear from first direct today I'll print out that letter and post it tomorrow. ARRRRGGGGHHHHHH I hoped I'd hear from them before having to do this as the prospect of going to court is scary!0

decided to reclaim my bank charges from first direct (part of HSBC) so sent the first letter from this website with a cheque for £10 on the 5th feb. i sent it recorded delivery in fear of them saying they didn't recieve it. got a letter back from them this morning (13th feb) saying thanks for your letter and they will be providing the information FREE OF CHARGE which will be sent by courier. i didn't think it was going to be easy but i am quite chuffed that i didn't have to pay for the information. Are all banks being this nice? anyway will let you know what happens next.

Quite a few banks have waived the charge. Maybe they feel guilty or maybe they just don't want to have to pay it back when you win!0 -

Hi I could do with a bit of help / advice, I sent my first letter off to first direct and got copies of statements, second letter was then sent, and I had a standard reply saying they will be in touch within 10 days, they did not get in touch so wrote and said I would be taking them to court if i had not heard within 7 days, got a letter this morning offering a partial settelment of 1450.00 (claim was for 2410.13) I do not want to accept their offer, so
1) do I carry on and start court procedings ?
2) what letter do I send declining offer ?
3) or should I accept their offer for part of charges and then press on with court proceedings for the balance ?
I hope someone can help, this site is really helpfull, but i feel I just need a bit more help with this.
Thanks0 -
Hi there
I am new to this forum so apologise if this has already been asked.
Can I claim my credit card charges back( Co- OP) ? I have sent a letter about 2 weeks ago with a £10 cheque and it has been ignored.
I have also sent a cheque to First Direct and they sent me it back saying they did not need it also the 6 years statements which I have just sat down and calculated, it was a big shock over £1100.
I want to play it safe so not asking for interest back but wanted to know it anyone has calimed from First Direct do they ask you to move banks if you do claim from them ?
Thanks so much for any help0 -

Go ahead and issue your court claim.
I would write to the bank with something like the following........................
I cannot accept your offer of £1450 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance.
I have made a reasonable effort to settle this claim before issuing a court claim, but you have ignored my efforts to settle this in a satisfactory way. I am now issuing a court claim for the return of these charges. This is in line with the notice I gave you in my last letter, and I will now settle only for the full amount of charges+statutory interest+court fee.How many surrealists does it take to change a lightbulb?
