I am claiming £3307 without interest from FD, just had an offer today for £2340. Which seems a little low.

Couple of questions. I have closed the account with them, but still have an outstanding overdraft with them, which i have an agreement to pay £170 a month off to clear it. On the proposal they have sent me they state that "....the funds will be credited to the above numbered account to reduce the outstanding balance." Does this mean they will refund charges, but only to pay off what i owe?? Can they do this??

If was was to push for more ie. court letter, what sort of time scales would it be?

    Thanks

I have had my bank statements from First Direct for the last 6 years and gone through them totting up charges.

I need to clarify - can I claim for overdraft charges AND excess overdraft charges?

I've already sent off my letter to FD asking for the charges back and including the spreadsheet detailing them but the amount I've asked for includes overdraft fees and excess overdraft fees.

Is this right? Or have I made a balls up?

I have FD account, the way i understand from their info on the back of statements, you are charged an overdraft fee for going over your agreed overdraft limit then for every debit that increases your overdraft in that statement month your charged an excess overdraft fee. So yes you can claim for both. I get these charges and took me a while to work out what they were for.

Blimey. I can't get over the amount  And that's not including interest either!!!

They have to have replied to the first letter by the 6th - which is then 14 days since I sent it. I've had nothing so far.

So if they don't reply at all to the first one, should I resend it do you think, or skip straight onto the second one?

Thanks for all your advice everyone by the way :)

No dont resend it, go on to your next letter.

Righto - talk about timing ;)

Just come home, I've checked my post and I've had my reply - what sounds like the bog standard 'We're sorry you've complained, we will reply to you in 10 days' type letter that all of you have had.

What comes next normally? Sounds like they've offered a lot of people a reduced amount right away, but I guess for the kind of amount I'm claiming for (£4K+) it might take a little more of a fight than that :(

I just want to know what to expect as the next step - or even if they normally do reply within 10 days?

on the 10th day they sent me another letter saying "we need a further 10 days" I issued my 2nd letter on receipt of this saying if i didnt here within 7 days i would go to court etc. The 7th day was a friday...I foned them on the monday and was told an offer was on its way out to me. I claimed £2147 and they offered £1825. They seem to offer 85% to most people, and say NO WAY to any interest claimed. I wrote back last week saying I agreed we should settle out of court but that £1825 wasnt a fair amount. I said to have the matter settled I would accept £2000. I posted that last wednesday. I tried to fone to offer this but they wouldnt talk to me on the fone this time "for legal reasons". I am obviously now waiting on a reply from them saying yes (or not) to my offer. Most people seem to be accepting the 85% offer.........dont know if ive done the right thing now !!

;) Just a little addition...to help your claim stay on track and to get to the right department faster without being shuffled around offices......if you mark your letter FAO S/CUSTOMER RELATIONS , on the envelope and/or on the letter(s) you send, it will end up in the right place faster.

    e.g:
    first direct
    40 wakefield road
    leeds
    LS98 1FD

    FAO S/Customer Relations

That is on the front of the claims reply envelope and under the name of the person who responded to us from First Direct!! Yep we got our money back!!
  • Received offer letter from DG solicitors on Friday for full amount including interest and costs, total £6086.00. Thank you Martin ! If I hadn't have watched you on GMTV I would never have had the confidence to persue this. My husband knew nothing about it as I wanted to surprise him. We have celebrated all weekend!
