    Why only sometimes?
    Some of them dont claim under the special rules.

    Most clinicians involved in palliative care know. However some people still choose not to claim under those rules, makes the finality of their condition all the more real.
    Gone ... or have I?

    Possibly, but the forms do mention special rules, for good reason they dont explain exactly what special rules mean but people can enquire or a representative can claim under the special rules for their client.
  • Please remember that ATOS and the DWP need to know if conditions have got better or worse. You mention your husbands condition has got worse therefore a medical is necessary to check he is receiving the right help.

    When you send in your ESA form, which you did, it first goes to ATOS, who have to do a preboard report which decides if you are likely to be suitable for ESA (either group) without a medical, or if they need to assess you in person. This recommendation is then passed onto the decision maker, along with reasons why.

    The ESA85a report is the form you need to ask for as it will (or rather it should, but most likely will not) show the reasoning behind why you were called for an assessment.

    Thanks, do I need to ring DWP or ATOS to request the ESA85a form?

    When I phoned DWP yesterday to request a copy of his last medical assessment report, I asked who actually got the ESA50 form first and was told that they did, not ATOS. But you are saying that it is ATOS who decide whether or not to call you in. Is this right?

    I feel ground down by it all, but I suppose this is what they want:mad:

    The question must be asked. What if the DWP state they consider you fit for work. You, possibly against your own, Doctors and possibly consultants recommendations therefor go and get a job as directed by DWP, you then have an an accident harming yourself or even another. Surely this would leave them open to legal action. ?
    I would certainly consider it so.
    The DWP = Legally kicking the Disabled when they are down.
