Ok, it's only a fiver, but you've been wrongly advised there. I sent £10 to Natwest and got a full set of copy statements (in colour no less) yesterday sent by special delivery. Sounds like a delaying tactic.

Calculated my amount and it came to £1085. This was the amount I had to get a loan to cover of course (from them, who kindly offered, see above) and I've made a major complaint in my letter.

Is it not mis-selling to offer a loan to cover unlawfully high penalty charges? Any thoughts anyone?

The initial request is not just for the statements, but also for details of manual intervention. I would be recommend, you get the full discolosure from the bank. The reason being, if it does get to the court stage, they could state that manual intervention has taken place on one or more occassions and use this in their defence. If you have asked them to disclose this and they have not, they will not be able to use it.

Wow, I'm shocked. Natwest were an absolute pain with statements for me. They haven't even included overdraft information and they've lumped together charges so it's hard to see what's what. I only know how different they are because they only send 4 years the first time and after a couple of phone calls and the delivery first of just another couple of weeks, I finally got full statements for the previous two years with all the info on. I guess it depends on branches.

  • nickmack, when you say manual intervention, what does this mean?
I am looking to get a reply sent off soonest if poss, and have just typed up another letter stating - copy statements would be acceptable. Is there anything else I need to put?
I want to try and do it the correct way, as they have taken about £800 off me over the last 2 years!

Manual Intervention may be a reason that banks use to justify the £25 or so charge for indiscretions. It means that a bank employee had to look up your account and make a decision whether to reject/accept a payment. This obviously does not occur regularly as decisions like this are mostly handled automatically by a computer system, but you would want to know if this has taken place on your account in case the bank tries to justify the charge.
  • i live in guernsey and contrary to popular opinion am not rich. i have been charged lots of referral charges over the years - many more since having a baby but does the same law apply to Natwest offshore. Does the legal advice apply in guernsey law aswell? Any answers?
  • Toby Dog - I requested statements from Natwest two weeks ago and recieved them last Friday (massive bundle!). There was no additional charge other the the £10 dpa cheque? ....£5 for your own statements....another unlawful charge!P

I'm looking to claim back £530 over 6 years (+ interest) and have sent my 14 Day Letter - 9 Days remaining. I'll let you all know how I got on.
