  • i sent my letter requesting £421

    the deadline for Natwest to reply is weds 27th dec, i have heard nothing up to today.........

    should i proceed with the letter stating, i will be taking them to court on weds

    or should i wait until the new year??
  • codebraker your timescales not the banks, would the bank wait to charge you in the new Year?

  • Hi everyone, hope you all had lovely holiday!

    Anyway, I sent my first letter and received an offer of a silly amount (Less than £100), I then sent another letter refusing this, I received an offer of >£900 but <£1000 which was very tempting but given that the total claim is >£1900 I was wondering if I should

    A. Reply saying that I would accept £1500 (My previous offer was >£1600) and see what the offer, the last offer is very close to a figure at which I would accept.

    Or

    B. Just go ahead with the court claim...

    Do you think they would respond or would it simply be better to just take it to court.

    If you go ahead and issue a court claim. You will very likely get back the total amount of your claim, plus interest, plus your court fee. I would carry on for the full amount.

    Thanks Rex :). Just in the process of doing the claim online now. One last question, should I make the claim against the address I have been sending correspondance too or the address registered on the thread on here?

    Ok so I've used to registered address as it says in that post.

    Just to confirm, I'm the clamiant, they're the defendant right?

    In the particulars of claim what do I need to put? Just copy my list of charges? I can't do that as it's some 1900 charateurs! Could I just put "Total charges = number - total interest = number total ="

    Hi hope some can advise.

    NW recently charged my son £28 because the interest they added
    (for his authorised OD) made him go over his overdraft limit by 68p for three days until his money went in.
    He spent months before playing catch up so that they stopped adding charges, he had been paying them for some years I found out!!! didn't want to tell mum, stand on own 2 feet etc!!!!, and only ever because of the interest, no bounced dd or anything like that.

    He sent them a letter asking them to refund it and any other charges he had paid and got the standard reply I have found out through reading this site.

    But he didnt know that you could cliam them back, just got annoyed and sent the letter. I have now shown/explained to him this site.

    Should he send off the first letter +£10 requesting the charges from the last 5 years, he doesnt have the statements going back that far, or has he started something that now has to be done in certain timescales?
    I notice that the 1st letter says 40 days to allow for a reply, seems a long time. He has decided to follow this through to the end, so would like to do things correctly from now on.

  • The 40 days is to give the bank time to send you the list of charges/statement over the past 6 years. Once you have that and start your claim the time scales to follow are much shorter.

    Thanks I thought that as he had already sent a letter that there might be problems getting the statements or with timescales.
