    Cobbetts seem pretty switched on over this process. Don't worry though, by law you have a strong case. I'm doing six different claims for people (no bank charges myself). The first of these cases was against Natwest. Cobbetts tried it on a few times by sending what could be scary letters to the average person, luckily I was dealing with all the letters that came back for the person. I could see what they were attempting, and carried on with the claim because I knew the case for the claimant was strong.

    I got a phone call just now from the person I was claiming for. The bank have sent a cheque for the whole amount including interest and court fees. No conditions were attached to the payment (unlike previous offers they've made, and we refused). The amount they've just paid was £3310.13. It seems stupid to me. If they had settled at the beginning, they would only have had to pay out £2610.50.

    Keep going everyone. The process works, and the banks know they have a weak case for defending these charges.

    Yes, if they had a decent defence for these charges, it would only take one bank to spend a few thousand on preparing their case properly and they wouldn't have continuous claims made against them.

    The fact they're shelling out time and time again, you can draw only one conclusion - they can't defend the charges and they know they're not enforcable.

    They're still doing they're best to put off claimants, but as Rex says, keep going, you will win!
  • A quick note to encourage people in their claims. I sent my letter to Natwest requesting satements on 18th November. The response to my second letter requesting refund of charges was a swift offer of a full refund of the £971 charges received today.

    So don't give up! Its really made my Christmas. Thanks for all the advice and examples followed on this site!

    I'm at the second stage right now, that is to say I'm preparing my spreadsheets with the charges having been sent all of my statements. Is there anyone out there who knows what they're doing or who has had some success that could look over my pages for me just to ensure they're in the right format and so on?

    i have sent the 1st letter asking for a list of my charges to the demons at Natwest. Does any one know how long this will take. Is it days or weeks. I know they only have 40 days though. Thanks

    i got my natwest statements within 2 weeks!

    They have 40 days. Some are getting them quickly, and some have to wait till the end of the deadline. When I wrote to them, they didn't reply within 40 days. A letter threatening to report them to the Information Commissioner for breaching the 40 day limit got the statements sent very quickly.

    Hi there,

    I sent my first letter requesting statements on 1st Dec, they came through on the 16th.

    Have now submitted my first letter requesting a full refund. We'll see...

  • Hi, this is on behalf of my boyfriend, who has a student account (think it changed 2 a graduate account in sept) I've just been looking thru his accounts 4 the last coupla yrs of statements he's kept & so far worked out that he's owed #146.92, I told him bout this & he's gonna write to natwest 2 get 5yrs worth of statments (how long he's had his acc. for), the only problem is, he lives in his overdraft @ the mo, times r hard, I'm still in uni, so he's payin rent etc. & cant afford 2 pay of his overdraft @ d mo. He's constantly up 2 d limit (not been ova & charged 4 some while tho). He's in quite bad debt from his student days so dont think he'd b able 2 open anotha acc. If he tried to get his charges refunded could nw just make him pay the full overdraft back, it's #1400 & we'd not be able 2 afford that right now.

    Ps. the reason I started 2 look in2 this is because RBS (part of nw) have told me today that they're going 2 b charging me #35 4 going 70p overdrawn, I'm a member of staff (work part time while I'm at uni) so I'm a bit dubious about writing to them, but I don't really care, I'm really angry bout it at the mo. ne suggestions on that would also be appreciated.
