    we been reading alot about bank charges, and weren't sure weather to do it or not. anyway chose to go for it. and we got all our bank statements back over last 6 years and natwest charged us a fiver. anyway totalled it up and including interest it is £3033.?? we haven't had any charges in nearly 4 years now , but i am starting to worry that maybe we shouldn't of done it.

    are natwest fairly reasonable ? as we know nearly everyone in our branch and they are all so nice. even if i see staff while doing my food shopping we stop and have a natter. we know most of them on first names terms and us them.

    i feel it is right to get the charges back as at the time it put us in an awful situation. going back through statements in one week we were charged over £200!!!!!. so glad not like that anymore.

    I did receive a letter to say they were looking into my claim after I sent the 14 day letter. I then sent the next letter giving them 7 days to respond and didn't hear anything then. I then sent them another 7 day letter requesting interest but I also rang their customer relationship department in Borehamwood and was told that they had put my offer letter in the post. I received that on Saturday 17th February but the letter was dated 8th February. Looks like they have a backlog. Wouldn't hurt to give them a call to make sure they have got your claim.

  • As for do I personally think you are wise to push for the court costs, try and weigh it up in your mind again today. Judging by the NatWest stories they will enter a defence to go right to the end so you would be looking at quite a few more weeks and a further £100 court costs BUT if you do go that far you would also get the interest as well as the court costs.

    Why not try phoning again later today and see if you get someone else on the phone and/or write back and say you will accept this offer provided they pay the £120?

    But... its not my decision!


    Mr0620 has again spoken with Borehamwood and they have told him that there policy is now not to refund court costs so we have decided to go all the way with them. They have un til next Monday to enter a defence with the court, if they do enter a defence what will happen then? If they don't enter a defence do we then win by default, and if we do will we get interest & court costs back?

  • well, the 7 days before I commence court action are up tomorrow. I'm looking to reclaim around £400, it's not a particularly big amount - do you think it's worth phoning Borehamwood before I go ahead with the court letter, or just plough on?

    If the bank does nothing and doesn’t acknowledge the claim and this means you automatically win by default after 14 days. At that point, you must request ‘judgment by default’, this can be done online, and you should do it as soon as possible after the 14 days ends.

    Banks have 14 days to acknowledge a claim, if that’s done they have a further 14 days to respond and enter a defence. Commonly they do an acknowledgement, but no defence is entered. Again this means you win, though this time after 28 days. At that point, immediately request a ‘judgment by default’, this can be done online.

    If the bank does enter a defence they are normally just doing this to try and make you settle, or argue that you've asked for too much (e.g. you've gone beyond six years or tried to claim compound rather than statutory interest).

    At this point you’re now in the Court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to Court. The next stage should be a Small Claims hearing date, yet this virtually never happens, as the banks tend to offer a settlement at this stage.

  • Following Natwest's threat of taking me to court over my account arrears and my cheeky response of,"Go on then,I'd be happy to go to court,lets do it", they have sent me a paltry offer of £1,500. Considering I'm claiming nearly £8,500 concerning 2 accounts, I feel they're trying their luck. So, I'm guessing my next step is to turn the offer down and...what...?

    Can anyone recommend a letter template or a way of wording my rebuttle?

    Claim against Natwest= £644.00 (without interest with interest £795.00)
    Paid up £644.00 (not going for interest)
    I cannot believe how easy it was! Got to step 3 asked for money back including interest recieved a nice reply saying that there charges are fair and transparent etc. but as a gesture of good will theyill pay £644.00 in full into our bank account! Accepted and should get money this week. Want to say a massive thank you thanks to this board. :j It has took less than 3 weeks to complete! We decided not to press for the interest as it was overdraft money we were going over anyway plus it wasnt money that was ours sort of speak and not ours to make interest off. We were happy to accept what they had taken of us. Anyone thinking of doing it JUST DO IT IT IS SIMPLE! HONEST! All it took was over a quid 2 envelopes a little bit time at the pc and thats it!! SIMPLE! CHEERS ALL XXXX

    HONEST JUST DO IT!!!! l waited for months before l did it!! The longer you wait you could miss getting charges back just do its honestly been no fuss what so ever!! Good luck x
