I was thinking of accepting the offer as part payment and still pursuing the balance.

Sounds like the bank is making an offer of what you are actually entitled to and if you decide to take it further you would then need to prove that a) you are entitled to claim overdraft interest and b) some charges that are now time barred. As regards the 8% interest this doesn't come into play unless your claim has gone to filing at court and is awarded by the court so I would suggest you think carefully about the offer the bank has made.

Yes i would definately phone and haggle, you wont be entitled to interest (if you have added that on in your claim) but from reading back on some of the success stories quite a few people have phoned with a figure in their head and have asked for more, apparently 90% of the claim about is a good amount,
They know that if you take them to court you will get full amount plus all the interest, why must they beat about the bush and stall things when they know in the long run they will pay up. Think they must like making more work for themselves.:rotfl:

I'll let you know as soon as letter comes, I don't expect to hear until next week, as they'll try and stall. I thought about asking for 90%, but I'll be happy with 8K, which is less than 90%, so they're getting a good deal from me dont ya think!! If they come back with something silly with £5K, I'll take em to court! I really, really don't want to go thru court process but I will. Think I'll have to sift thru old paperwork, to see if I can get any more back of other companys, but to be honest I'm so crap with money, years gone by, I can't even remember who I owed & what I owed - not any more!:D Stick with it Lou and good luck! I'll only breathe a sigh of relief when that money is in my account!! Mind you, they paid up and took it off someone didn't they?!

I am about to send my letter to claim back my bank charges(£2757.00).
Should i try and claim the interest as well,(£695.85)or will i have more success just claiming the charges.

Hi ya,
you can add the interest, but you aren t actually entitled to it unless you take them to court, but be all means show them it all, might be useful in long run if you need to negotiate a figure before court action if they dont give you a reasonable offer.

Hi everyone,
I sent my first letter asking for 6 years worth of statements last month (using templete from this site), enclosing a cheque for £10.00 and giving the 40 day deadline etc.
I sent the letter to the data protection officer at HSBC using the address from this site.
That deadline expires on 23.06.2007 and I still haven't heard anything.
Has anyone else waited this long to get the copy statements?

Hi, I am at the MCOL court stage with HSBC who owe me £4,401, they claim I have miscalculated and the actual total of charges is £4118.50. With added interest the amount came to just over £5,500, the amount I have claimed is £5,000 (as I am aware you cannot claim over 5k in small claims court?) That means I have already reduced the claim by £500 in their favour! HSBC have written to me offering full and final settlement for the sum of £2,855. I do not want to accept this offer as they have already stated in writing in this letter that they calculate the charges to come to £4118.50!! I'm not bothered if I don't get the interest in full by I do want to reclaim all the money they have charged me so please can someone give me some insight into what I should do next. Do I contact MCOL? Do I write to HSBC and refuse the amount and suggest an out of court settlement for the £4118.50 they claim they've charged me without the added stat interest? or shall I just see the whole thing through to the endm and if so how?
I'm getting a bit nervous now because I really need this money to sort out my debts. Please help, thanks - Sue

I have to say that I cannot recall seeing anything which says whether the small claims court limits (£750 in Scotland, £5000 everywhere else) are just the charges or include the interest.
Politely refuse the offer in writing. Keep a copy of the letter for your court bundle. It is then up to them to respond - they can either up the offer, file a defence, pay up in full or let things continue to a judgement by default.
You aren’t legally entitled to the 8% per year statutory interest on the charges unless it is awarded by a judge.

I originally sent the letter asking them for copy statements but then decided I didn't want to wait 40 days+ so decided to do the leg work myself. If you have access to online banking you will be able to see all your statements for the last 6 years. It might be worth doing this yourself just in case they take longer to send you the info. If you can list all the charges yourself from the statements online, you could have your claim sent off before they send you the statements! It will take a bit of time to go through them but could speed up your claim time.
