Hi I just rang the complaints department and they say a decision has been made and a letter has been sent to me but no one can see the contents of the letter or the decision before I get the letter which takes 5 days.
is this another stalling tactic or what.

    Regards

Hi- I have already totalled and added interest to my previous charges, and written to HSBC asking for them to be repaid. Around 14 days after sending this letter I got a letter from HSBC saying that someone was looking into it and would be in touch. This was over 14 days ago and I have since heard nothing. Is this just HSBC trying to delay or scare me off? I'm sending them a letter saying that I will be pursuing the matter through the courts today, was just wondering if anyone else had received a similar letter during their claims process?

I think you'll find it helpful if you read back through this thread; you'll see that these are standard letters so you should stick to your own timetables and send your next letter.

Just got in from work and checked, as suspected they have left it to the last minute to file a defence with the court. Claiming £2910 including MCOL fee, so we'll see where it goes from here. I assume the AQ will give me a choice of courts so i'll be off to the Southampton small claims court in due course. These thieves have stolen enough from me over the years, so im not giving up now!

My MCOL was acknowledged on the 6/03/07 too. I called MCOL today, and they told me the bank have up until the 9/4 to defend.

HSBC is really inconsistent. Reading through some of the threads, some people go through this process, and some do not get to the MCOL stage. My claim is over £1500, so when they defend it, more money to pay out for the allocation questionnaire

    No giving up now.

Does anyone understand the inconsistencies, with HSBC?

    Thanks

When you say they have lodged a defence, do you mean they've acknowledged the claim? If they've lodged something other than an acknowledgement you'll get an Allocation Questionnaire to fill out - if you read earlier threads, offers tend to come out a few days before your court date.

And yes, if they're making offers surely they're admitting liability? Ridiculous, but on my offer letters they say they're only making the offer because it will cost them too much to go through the court process. SO WHY DON'T THEY JUST PAY UP STRAIGHT AWAY?!

Yes I have received a questionnaire to fill in. I am going to post it tonight. Do you know how long on average I will have to wait before I have a date set?

I am hoping to take my 2 terminally ill nephews to Disney in July and was hoping that this would be helping to pay!!

    Hiya

no you cant claim that back however you can add your own 8% statutory interest onto your claim (see the interest calculator) BUT the banks are not obliged to pay this out unless you win via the courts

    hope that helps xx
  • hiya many thanks for the reply to my message have sent the 2nd letter and included a breakdown of all charges plus used the calculator to wrk out interest so fingers crossed thanks again
