    I have 2 accounts at A & L both with charges on so I'm trying to reclaim them. I've done separate letters for each account and have so far got to the "no we are not going to repay you" stage. I have now sent off the letters telling them that I'm going to take them to court but they can pay me a lesser amount if they wish (one of the template letters) On one account I have charges of £1649, £1739 with interest and said I would accept £1200. The other account is £490, £700 with interest, would accept £350. I was just wondering if anyone else has had success doing it this way or if they have had to go all the way and take them to court. Surely it would be better for A & L to agree to pay rather than go to court and pay out the full amount plus costs wouldn't it? To be honest, I'm really worried about the prospect of having to take them to court anyway which is why I sent them the letter giving them the chance to pay the lesser amount!:eek:

    Also, since starting this reclaim, I have been waiting for a new cheque book to arrive, I suspected that they hadn't sent it because they know they will have to pay out one way or another, then they will close my accounts. I phoned customer services and the woman I spoke to "couldn't comment" on that and she would look into why my cheque book hadn't been issued and get back to me - she hasn't. Has this happened to anyone else? :o

    Judge's orders arrived:eek:

    Basically have to prepare a Statement of Evidence, submit schedule and all supporting papers (i.e. court bundle) within 21 days. Court date set for 1st August. The bank's been asked to declare how they reach their costs, produce a contractual document, witness statement, etc. and legal papers. Claim to be struck out if either party doesn't comply.

    Busy printing off court bundle papers and trying to make sense of it all at the moment ... just hope my old printer holds out:rolleyes:

    Must then get my head round the Statement of Evidence.

    CHARGES TOTAL £720 + %% £270+


    At long last after receiving the silly standard letters stating that these charges could only be claimed from credit cards Blah Blah!!! I threatened court and I have now recieved an offer of £175... I am not impressed :eek: although a little joyful because They R admitting fault by offering me anything.

    I intend to press on to court proceedings BUT I would be extremely greatful to anyone with advise on doing so in Northern Ireland AS we can not use Moneyclaim:confused:

    I have just realised on A & L's copy of the AQ (that Wragge sent me) it says they are calling 1 witness. Do you think this is ok? Who do you think they are going to call?

    I wouldn't worry too much about it ... chances are they've just put this in to worry you and haven't any intention of turning up in court.:rolleyes: I would think they can put in what they like to try and frighten you into giving up.

    Alliance and lleicester have sent me a settlement letter offering me 78 pounds a insult as i added charges to over 700 pounds,
    but in there letter they said that the charges are lawfull what do i do??:confused:
