    Your lucky, They are doing everything to avoid me, even court actions doing nothing, and now the district judge has suspended all bank charge claims dont think i'll get anywhere

    Dont take it. I have taken Alliance & Leicester to court and they did not even reply or submit a response within the 14 days they were allocated. I passed judgement on them by default and they have now been ordered to pay me the full amount. I received an offer from them two days after i had passed judgement on them.

    What figure would you say is worth claiming for and when looking on the sites the A & L seems to be the best current accounts but as my husand's credit report isn't great I am penalised so no overdraft facility will be put on my account I have been with them for 14 years. Any Advice Please:j

    I have just won by default after taking A&L to court. I am currently waiting for my cheque and i havent got a clue how long that will take to come through. I passed judgement by default on the 21st May and on the 23rd I received a letter offering me a small amount! Doh i had already won the full amount.

    just wanted to say thanks to martin. this is dead straightforward, just follow his guide to reclaiming BY THE LETTER and you cannot go wrong. I filed a claim on moneyclaim (county court) on th26th jan and today received a letter from alliance and leicester's solicitors saying that essentially they dont owe me a bean BUT they have paid IN FULL as its not worth going to court!:beer: :j :T :T :T :T :T :T :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :rotfl: :T :T :T :T

    I passed judgement on A&L on the 21st May by default as they did not acknowledge or submit a defence. the order has now been forwarded to them for them to pay me. How long did your cheque take to arrive?

    The basic court bundle is on the CAG site, but you have to tailor it to your own needs, it depends entirely on what you local judge asks for when he lets you know the hearing date.

    Some people are being asked for Statements of Evidence and some Witness Statements, etc., but all these need the relevant legal papers attaching to support them and they're all in the court bundle.

    Really a case of trying to get your head round it all, deciding what you need and producing a proper detailed index. Best not to copy it all until near the time it needs to be in ... there's probably 200 pages plus in total.

    Started to print off the basic stuff, but will be asking lots of questions on the CAG site soon ... don't wan't to mess up now I've come this far:rolleyes:

    Wow, finally a result somwhere. I have been on the CAG website and someone else has one of these letters as well for 1st August.

    Does your letter say something about they have to show how much the charge costs?

    Firstly please don't write in caps as it is considered shouting.

    May I ask why you decided to take a national bank to court without doing your homework? You are going to have to take on the bank, their solicitors and the court system.

    It isn't that difficult, but neither is it trivial or easy. You need to read up on it all (not just take the easy option and ask).

    But to answer your questions.

    You will have been transferred from Northampton to your local court as Northampton is the clearing court for MCOL.

    An Allocation Questionnaire is to aid the court in deciding what claim track to put you on. Small claims, fast track and so forth. Ultimately it is based on the amount you are claiming. The likelihood is that you will receive a letter dispensing with the AQ because they know by experience of all the penalty charge reclaimants that you will need to go on the small claims track. If your claim is for more than £1500 you will need to pay a £100 allocation fee.

    If you have no idea how to prepare for court why did you take it to court? You need to do your homework, like each and everyone of us.

    I find the tone of your message more offensive than anyone writting in capitals!!! Can we please remember that we are here to support each other not chastise people. Everyone is in the same boat and if others can benefit from the expertise and wisdom of those who cases are in advance of others then all the better. Its called learning from our mistakes or if you like business jargon "lessons learned"!!! We should have solidarity in numbers against a corporate entity that clearly has no respect for its customers. At the very least we should show respect for each other, or else we're in danger of becoming hypocrites!!!
