    I'm surprised that you had to go to this extreme. I exceeded the o/d limit once, went straight into the branch as soon as I realised and deposited enough to bring it back within limits. Then I phoned from the branch (free phone call too), explained the oversight on my behalf, they accepted it and refunded the charges there and then.
    Easier peasier.

    Although in over 3 years this is the one and only time I have ever exceeded it, so maybe that is a mitigating factor. Don't know if your circumstances are different.

    After the first few times of being charged for going over my overdraft limit (only by a few £s each time I might add) I went in to my local branch to see what could be done . They (manager included) said they couldnt do a single thing , I would need to phone telephone banking . They wouldnt even look at the charges on the computer at the branch , EVERTHING had to done via telephone banking . Phoned telephone banking and they were pretty unsympathetic and only refunded half of one of the charges , £12.50 of about £250 worth of charges in 4 months . These were mainly over the Xmas period a few months after we bought the house and we were running our finances pretty tight each month . We went over the overdraft limit about 4 times , but the last 3 times would never have happened if the first set of charges were significantly lower , it was a vicious circle , as the charges are the only thing that sent over the overdraft limit the latter 3 times !!!
    The only reason I opened an account with A&L was my GF and I needed a joint account when we bought our house . Our mortgage was with A&L , but this brought us absolutely NO favours , sympathy or loyalty with the bank account .
    I shall be closing the account down pretty soon (although according to the tone of the letter I received from them they will probably be closing it soon anyhow) , and I will be moving my mortgage from them when my 2 year deal is up in August and I will never darken their door again .

    I advise anyone with illegal charges to do the same as it was one the the easiest things I have ever done . All done online , hardly had to lift a finger .

    Only started the application at the end of April . Small claims pack sent 3rd May . Letter and cheque from A&L received 24th May .

    Apparently the banks (and maybe the courts) are awaiting the outcome of the OFT investigation . It will most likely set a figure they they say is fair for charges , probably around £12 the same as credit cards . You will then probably only be able to claim the difference after that .

    Hi peeps

    Well I found the T's & C's, and had put them in what I thought was a safe, easy to remember place.

    Obviously I forgot where I had put them. I eventually remembered where I put them and then had to spend about 40 minutes to find the thread that I am to post them to.

    Now I have to find out how to attach something on a thread. Have you seen the time I posted this thread, won't be on again until tomorrow night I think.

    I have one for 2002 and one for 2006 I think. Will post on two different threads.

    Will maybe start a ew thread also for everyone's copy of T's & C's.

    It's not a great scan so if you would like a photocopy sent to you, it's not a problem, email me and I will email you my address so you can send a SAE and I will photocopy and send. A photocopy should be better.

    I scanned my recent T&C's and printed them off ... they were completely illegible and very blurred, so ended up doing a copy (which isn't that good as the writing's so small and some of it's in colour:rolleyes:).

    I filled out my AQ today, all cool, but should I send a copy to solicitors?

    Solicitors sent me a copy of defence AQ and they are also suggesting they will call on a witness. Oh Im so scared, I'm quaking in my booties.

    Cant wait for the case now, and to meet the defence with their imaginary 'witness'

    Grow up solicitors!!

    Wow you're brave

    They called 1 witness in mine and I'm panicking because they haven't called any in someone elses AQ. Do you really think they won't turn up?

    Still telling myself they won't.

    I think I may have made a couple of mistakes, can anyone advise???

    1, On MCOL I have entered 1st defendant and 2nd defendant (A & L for both) as I was claiming on 2 current accounts, not sure now why I did it, do you think this matters.

    2, I didn't send a copy of my AQ to the the solicitors, is this ok or should I send them a copy.

    3, POC on MCOL entered the interest amount £3 less than it should have been. All other figures were correct including my main claim fugure. I have since sent an updated spreadsheet (with daily interest) to both solicitors and the court. Do I need to do anything about the poc being wrong?

    Hiya all,
    just got back from holiday to find an offer for £180 from A&L (including £80 for the court fee). They are saying they are prepared to offer the difference between the original charges and £12, but not the interest. I am looking to claim around £700 inc interest!! I also recieved a load of bumpf that points out LloydsTSB successfully defended a case recently, which is also attached to A&L's 6 page "defense" in my case signed by a trainee !!!! Do I cash the check for £180 and consider myself lucky or do I bite the bullet and hope I can get at least this from a court? Any advice on this issue would be gratefully appreciated!!!!!!!
