Oh why does something like a mobile contract get so flaming complicated?
I should really be sending my phone back to Phones 4U then if that's the case. My head is bursting with the whole thing :mad:
There's a guy in level3 iPhone support calling me tomorrow, he's been really helpful in the whole thing but he doesn't have authority to cancel it for me. I'll wait till he calls and take it from there.
I just want out of this contract and move on.
Have you tried going back to Phones4u, I think they have a different cancellation policy than most places and might be of more help than Orange.
O2 were glad to have me back, I was stuid to leave them in the first place, the grass is greener on the other side and all that.
I've lost a tariff thats not available anymorehave to pay for texts abroad and mms this time round.
But they gave me a good deal non the less so i can't complain.0 -

I bought mine direct from Orange via their website.....and having read the Terms and Conditions on the link posted by the Orange rep on this thread, that doesn't apply to me.
If I can cancel my contract then Orange have no claim on my handset because according to their Ts and Cs I've acquired it outside of the contract.
The fact that yours are different to mine and we're both on the same network just proves that it's necessary to be sure of your position.
EDIT - I notice that your early termination charge is only valid for 120 days from first bill. I'd read it that after 120 days there is no charge and the phone is yours regardless of any contract.
I suspect Orange if the phone was not to be returned refuse to cancel the contract or simply levy a fee on it.
I.E make a deal of return the handset and we'll forget it otherwise the termination fee is £400?0 -

Possibly....but it's not in the contract so any "deal" such as the one you suggest is pretty much either blackmail, or doomed to fail.

They don't have to cancel the contract, the condition of them doing so is that you send the phone back0

As drbesty stated below there is no legal requirement for them to cancel a contract for signal issues.
If a customer has agreed to pay £30 for 24 months and are 2 months in you owe them £600 or so as settlement. If they are happy to cancel the contract but waive that payment for returning the phone it is a no brainer in my view and trying otherwise to keep it is a bit cake and eat it. Good luck but I don't see it happening very often for the operators!0 -
Hey, toe jam, how long was left on your contract, i'm 14 mths into a 24 mth contract, got it down to £40 a month on an iphone 3gs but coverage at my house is none existant even tho it states it should be excellent according to there checker. I got a replacement 3gs in december under warranty because of some cracks on the back near the charger dock and was informed that i can get a new phone so mine is only 3 months old. Really want out of orange and wish i'd never left vodafone now. There is plenty of bad press for them on their facebook group and even a website for orangeproblems lol.0

Their coverage checker is an outright lie. There was 19 months left on my contract. My number is due to port out on Tuesday and I hope thats the end of it, but knowing Orange i'll get a final bill for several hundred pounds, even though I have it in writing that there will be no exit penalty.
Im back with O2 now, but i have no handset because I sent the phone back. I'm not starting another 24 month contract when all the mobile companies are being forced to give 12 month contracts from May.0 -

The contract does state that the it may be cancelled if Orange cannot provide access to the network.
I accept that in places and at times, the signal will drop off, but in my case, where I struggle to get internet, calls are dropped and incoming calls go straight to answering service, then they're not fulfilling their part of the contract.
The point of a mobile phone is to have access to a phone when out and about. In my case Orange are clearly struggling to provide that service.
After several calls to the help centre, they're now replacing my phone. I should have a replacement handset tomorrow or Tuesday. That in itself is an admission that something is not as it should be. If the replacement phone has the same issues then I don't see how Orange can claim to be providing the service I'm paying for.
