  • hi debsxx just ignore this letter i receive 2 3 and this private operatore have no power ti issue a ticket and this is not enforceble by low they will do nothing but just sending scary letters

  • I too have just received a fine from APCOA. My husband dropped me on the roundabout at Luton not because we didnt want to pay the £1 but because the traffic was so heavy getting into the drop off zone. Was gutted and just about to pay up quick when I decided to check it on here and boy am I glad that I did. What I am wondering tho is if they have proof of the contravention and whether to ignore the letter completely or ask them to prove the offence took place. I am presuming they must have it all on camera and if it went to court how we would stand. Can anyone help please?

    Boxxy just completely ignore their demands for payment the invoice, you haven't been fined so you have no requirement to pay them at all, enjoy keeping your money!
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Have a look at the thread re OPC lose at appeal.

    In it the judge clearly says that if you park (or stop) where you are expressly told not to and are then charged , this is not a contractual charge. It could only be a contractual charge if the contract actually allows you to do what you did for a fee, but it doesn't .
    It specifically says no stopping ..so the £80 is a penalty ..penalties are unenforceable in a contract.
    The only thing the landowner or the PPC could take you to court for would be tresspass and even that is debateable as the contract allows you to enter on to the road and use it but not to stop to drop off.
    If they were to win they can't claim £80 they can only claim a reasonable pre-estimate of losses and damages ..that's never £80.
    If you are in any doubt perhaps you should look at the Luton Airport website where the charge is described numerous times as a "Penalty Charge", and it's stated intent is to deter you from stopping.
    It was NEVER their intent to allow you to stop there provided you paid £80.
    With the website as it is and the recent OPC judgement I can't see how you could possibly lose in court AND more to the point APCOA KNOW this ..they won't dare file any claim at court against you ..IGNORE THEM THEY ARE TRYING IT ON !!!

    If you check your previous posts I think you got a reply the other day to say it was apparently during February sometime.

    Does it matter? Ignore anyway if ever you have a PPC fake PCN. Do not write, do not state your case, do not believe there's an appeal process as there is NOT.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Morning All, just received one of these "fines" myself yesterday, was gonna pay and get rid of it, but I'm glad I landed here first. I'm currently dealing with Payplan so I reckon I can handle some letters from these cowboys and highwayman, you have just strengthened my resolve. I actually think I was away from the said Bus lane or roundabout where I did the dropping off, but I guess their cameras reach all parts if they think they can may a buck or two. once again thanks for your advice.
