ANOTHER Letter from Debt Collector..what to do?

    Fuzzgun - someone else just started a thread re: Littlewoods and a certain debt collector. Her debt seems to be over 6 yrs old which she had paid off. I wonder is there is some scam going on here?

    This debt has again turned up with a different debt collector.

    What should we do now, we don't want to end up in court?

    Is this just more 'scare' tactics, and should we reply to it?

  • Hey Fuzzgun19, Looks like the previous company just passed this on to another DCA and they are trying thier chances of getting it back by making the letter look more official but in the end it's exactly the same deal as the last crew.

    Ask for a copy of the original signed agreement as you do not admit liability for this debt stating the same rules as before. ie no signed agreement no debt, now go forth and multiply!

    It seems a pain Fuzzgun but looks like you will have to go through it all again just with another company, but don't give in! Better a few minutes wasted with letters than a grand or 2 wasted for a debt thats not yours and if it is, is now statute barred and unrecoverable.

    Thanks Nemisis, this is what I was thinking, but wanted some confirmation from you guys.

    Seems weird they are passing the debt round, when if this was really a recoverable debt then wouldn't one of the DC's have had us in court by now...?

    I will send the letter below asking for the SIGNED credit agreement today and post back with any results.

    With reference to the above agreement, I would be grateful if you would send us a copy of this Signed credit agreement. I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of my Signed credit agreement on request. I enclose a payment of £1.00, which represents the fee payable under the Consumer Credit Act.

    I understand a copy of are credit agreement should be supplied within 12 working days.

    I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    I look forward to hearing from you.

    I have just sent moorcroft a letter similar to that myself...they should have received it today.

    please guys, this letter could get you in trouble.

    You need to add the following sentence, other wise your letter could be construed as acknowledgement of the debt!

    I do not acknowledge ANY debt to your company or your clients.

    Thanks RAS, but I already sent the letter yesterday..

    Would not including that statement make much difference?

    This is exactly the same letter I have sent the previous DC's, and they seem to have 'gone away'..?
