ANOTHER Letter from Debt Collector..what to do?
Comments
-
The saga continues... (Never heard again from Moorcroft DCA)
Had the below letters today from 'Shop Direct Financial Services'
The Letters mention 'Phoenix Recoveries Ltd', and also 'Red castle Recoveries' (both in the same envelope)
Can anyone advise if this is the same old same old as before?
Do I just send them the same letter asking for a copy of the signed credit agreement?
Any help appreciated!I Hate Jobsworths!!!0 -
This looks like the same old same old to me, your "debt" has been passed on or sold to another debt collection agency as the original lot could not recover it, so have sold it on to another lot of time wasters who will try the same on you, so all you have to do is the same rountine and since i doubt they will find the original signed agreement also, it will most likely come to nothing.
Makes you wonder though how long this will go on for? When will they get the hint that this debt is unrecoverable?0 -
my littlewoods debt got passed over to this bunch and i asked for CCA etc and have never heard another word from them0

Thanks guys, I will send them the letter tomorrow.
Do I still keep having to put in a £1 cheque?I Hate Jobsworths!!!0 -
The £1 payment seemingly makes it a contract that they have to honour.
Which is probably why the guys that were trying to chase me for a loan i never had returned the one pound postal order i sent them and i never heard from them again.0 -
What I normally do in this situation is to write to the buyer saying that I am disappointed to have to inform them that they have bought an unenforceable debt (enclose the letter from Littlewoods agreeing not to pursue) and that if they were not informed of this by the seller they may wish to take up the matter with them.
It sometimes works - I assume that they get their money back.
But sometimes it doesn't.
Whatever the result this is unenforceable and I wouldn't waste any more time on it. If they try court action, you have a cast iron defence under the Consumer credit act - I can send you the wording if you want.0 -
Thanks fatbelly,
yes please, it would help me alot if you could send me the wording!I Hate Jobsworths!!!0 -

Just to update.
We have received our 'Request for credit agreement' letter back, along with our £1 cheque.
Looks like this was yet another attempt to obtain the money.
We await the next DCA to try.. lolI Hate Jobsworths!!!0 -
Good to see fuzzgun.
One thing i would suggest though - don't send a cheque but a Postal Order. You don't want them to have a copy of your signature if they are one of the more disreputable companies. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
