ANOTHER Letter from Debt Collector..what to do?

Hello,

Previous threads about this subject are HERE and HERE

We have heard nothing about this for months.

Have today received the following letter -

And this is the letter I received from Littlewoods regarding the account -

scan2_000.jpg

I have today sent the Debt Collectors this -

Dear Sir/Madam:

Re: Acc. No. – XXXXXX

I an in receipt of your ‘Final Demand’ letter dated 7 November 2006.

I will not be making payment, as my creditor has confirmed that they are no longer pursuing the balance of Littlewoods account number XXXXXX.

Please see enclosed copy of their letter.

Yours faithfully,

When we received the last 'demand' from NDR Debt Collectors in July 2006 I sent them a copy of the letter from Littlewoods and asked for a copy of the original signed credit agreement and a copy of the letter of enforcement that they have from littlewoods acting on their behalf (incase they had sold the debt to the 'NDR debt collector'), but got no reply...

What shall I do about this latest letter? are this new DC trying it on, or shall I send them a letter asking for a copy of the original signed credit agreement and a copy of the letter of enforcement that they have from littlewoods, like I did with the previous DC?

Seems this is getting passed around from DC to DC? im not sure what to do..

  • If Littlewoods have told you that they aren't pursing the debt then a DCA can't purse it either as far as I'm aware because the DCA won't have had permission to chase the debt.. Just forward a copy of the letter to them stating you do know ackowledge any debt to them as littlewoods have written to confirm they are no longer pursing the debt.

Is the DCA acting for littlewoods or have they bought the debt?
    Regards

    I have no idea.

I have today sent a letter to DC asking for a copy of the credit agreement and notice of assignment enclosing £1 cheque.

We shall see, bet I dont get a reply and they just credit the £1 off the debt like the last DC did.

Seems to me they are just passing an old debt around in the hope they will get some money, not knowing that Littlewoods have 'written it off'. (well...these lot know now!)

I'll probably get a different DC every few months trying.

    Any thought welcome :)

I think that the DCA is 'Bounty Hunting'. Since you have the letter, from Littlewoods, there is not a lot that Debt Managers can do about it.
I, personally, would write to Littlewoods and ask them to call off the dogs or you will report them to the Trading Standards.

Every time you get one of these letters just send them a copy of the littlewoods letter and tell them you will not be paying. That should get rid of them. If any of them do write again thats the time to demand a copy of the signed credit agreement.

    Have today received this letter-

Is this another 'Scare Tactic' or do you think they really will/can start action?

On the 11th Nov I sent them a letter asking for a copy of the credit agreement and notice of assignment enclosing £1 cheque, giving them 12 days - No response yet.

    What shall I do now??

The case would be thrown out of court if you have a letter from littlewoods saying that they aren't pursuing the debt. The DCA are just trying to scare you into paying..
Notice how all the scary words are in bold, and that it comes from someone at the 'court' department. All tactics to scare you into paying up to a debt they probably aren't even entitled to be claiming.

  • yes these letters just look like the rubbish and waste of paper sent out by dca, not worth the paper they are written on if i were you i would check with littlewoods they have not sold on the debt my guess from old experiance they have if so just tell the dca to prove they have purchased the debt its your right to do so and then take a step back and decide then what course of action to take
  • If it were me I would tear the letter into iddy biddy pieces and send it back to them. Well worth the 32p for a stamp.
