I agree that a letter acknowledging the debt is tantamount to an admission and should be considered only with some professional guidance. I don't know anyone with 'Legal' knowledge unfortunately. Think I would have to rely totally on the good people of this site.
I am going to call Littlewoods and see if I get anywhere, and then take it from there.
If they have sold it to DCA, do you think THIS letter would be ok, or should I just call the DCA for quickness?I Hate Jobsworths!!!0 -
You really need to get advice on that letter from someone other than an anonymous poster on a public forum. Just look at the different personal opinions already on this thread. Go to this link and if you don't get help - come back. http://www.clsdirect.org.uk/about/index.jsp?lang=en

I really think you need to get legal advice rather than from here. So you can make ABSOLUTELY sure you are approaching this the right way0

If they have sold the debt then don't acknowledge it. Ask for proof of the original agreement and a certfied copy of the original signed deed of assigment. I can provide a superb letter should you need it. To be frank its unlikely they will sue. However, I like their wording. It is against OFT guidelines to say you WILL sue if you are not actually intending to, hence many DCAs now say they MAY issue court proceedings.
And why do these companies that deal with people that are apparently broke and cannot pay their debts insist on using the rip-off 0870 numbers!0 -

ok, Called Littlewoods and it seems they DID sell on the debt to 'Debt Managers' (nice of LW to tell us).
Called DCA and arranged payments of £10 per month to them. They are going to send out a letter confirming this.

I am glad that you are satisfied with your decision, although I can't help but feel that this 'debt' was unenforceable by the DCA and that Littlewoods appear to be going back on what they have said in their letter.
Still, as in all things, if you are happy, then that is the main thing.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
