O2 Broadband - Cheaters

At the beginning of November I have signed up for O2 Broadband+Land Line over the phone for a 12 months contract. I was given a choice of their three packages: Basics(Cheapest), which has 20 GB DOWNLOAD LIMIT. The All Rounder with Unlimited downloads and The Works(same as The All rounder, but with higher Uploads speed. I have told a salesman that I would only consider unlimited downloading package and as I liked the price of The All Rounder package and don't need the fast uploads that the most expensive package offers.
Until a few days ago I was not using an internet too much until I have discovered a website wit lots of films that I like so I have started a heavy downloadin spree. After 2 days my internet speed suddenly reduced from around 5MB/sec to 0.2MB/Sec. I have received an email from O2 that as I have reached my download limit:mad: of 20GB my internet speed has been reduced until my next bill. I've then gone to my O2 account and found ot that I am on the wrong package - The Basics.

I rang the O2 and asked them why am I on the Basics package and was told that, that is the package I have gone for. As I have rejected this and told them it is the staff error, I was offered to be upgraded to THe All Rounder, but also made aware that it has a download limit of 100GB, something salesperson has never told me and that the only way for me to get an unlimited broadband is to go for The Works(I have found out later this one also has a Cap of 250GB wich means that O2 don't do an unlimited broadband as they claim on their website). I have refused to do so and told him that as O2 has breached the contract agreed on the phone(To provide me with an UNLIMITED The All Rounder Package) I am under no abligations to continue paying them and I shoul be able to cancel it it straight away or if they were happy for me to do so, go with their 30 day contract as I am planning on moving houses soon and there is a good chance there already will be a broadband so I couldn't transfer my broadband there as there might already be one.I would have to pay an early cancelation fee which I wouldn't have an objection(not pleasure) paying as it would be a breach of contract from my side. However now the situation is that O2 has breached the contract with providing me with the wrong service, so I feel that I should be able to cancel at any time. The guy has replied that there is no breach of contract from O2 as he offered an Upgrade for me. I have told him that I have agreed to go for UNLIMITED The All Rounder(which does not exist) from the 1st of November 2010(that is something that they could not do nowas that is the date in the past:j however that is what I was told I am geting) I have told him that I want that to be processed via formal complaint route(I want them to listen my conversation with sales guy) and was promissed to get a call within 24 hours - never happened. After I have called them I was told I need to wait for 5 working days, so no football streams, online :(. They have also refused to increase my speed temporarily until it is resolved...

What do you think guys, what are my rights here?(complaints to Ofcom can only be made afte 8 weeks - not the time I am happy to stay on a slow broadband)

    Go here:-, https://www.o2.co.uk/broadband/. Unlimited is as usual subject fair usage.....and you're talking nonsense about being unable to transfer your broadband to a different house that has broadband.

    I believe the only provider to do truly unlimited is Sky - Not what you want to hear, But o2 don't usually budge

    but 250gb is ALOT of films!! Even 100gb!! at 796mb (standard film length)

    After two days you were choked? 20GB at 700MB per film is 28 films. So that is 42 hours of viewing - only three hours sleep per night. Plus at a cost of £28 or £56 or £279.72 to pay for the films (you are paying for the films, aren't you? Or are they from an archive?) Even if it is only 14 high definition films you still need time to bother watching what you are grabbing.

    I suspect you have not watched all the films - surely this will give you some time to watch and take pleasure from your 'purchases' whilst awaiting the resolution.

    If I move to a shared acommodation with a broaband included in rent, why would I pay for installing a separate Land Line?

    I have paid for a 1 week access to the website downloads thats why I've started to download many films at a short space of time so I could gradualy watch them after, but now I am unable to do other activities online, like watching sports online. Also as I was downloading films at the same time half of the the downloads got cancelled half way through(they did not allow to use download manager)

    You wouldn't. But that is not being 'unable' to do so. And O2 is not the one obliging you to flit.

    If there was an existing Landline in the house occupied by some other broadband unless they were happy to cancell their broadband and switch to mine, I would need to install a 2nd landline an pay for it

    The problem is that I hold a service with O2, I have never subscribed for, that was missold, so I should not have any obligations to them
