    HI...SORRY FOR BEING A BIT "THICK" BUT COULD SOME ONE CLEAR UP A POINT FOR ME.....THESE SO CALLED FINES ARE NOT ENFORCEABLE....NOW ARE THEY ONLY NOT UNENFORCEABLE AS LONG AS a) THEY CANNOT IDENTFY THE DRIVER
    b) IF THEY HAVE EVIDIENCE/ YOU ADMIT IT WAS YOU DRIVING..THEN THEY HAVE A CASE
    PLEASE ADVISE......
  • The site you are discussing is on CCTV, the signs have been up for sometime but they only started issuing tickets a few days ago.
    You are correct there were a few tickets issued, but in fairness all vehicles are in clear view of the signage and it has been there for a long time.
    They have tried all things previously to stop the students parking but they always get ignored.
    All CCTV has been sent to us, so we know exactly who was driving, when they parked, how long there together with the still photographs taken when the charge was issued.
    You are entitled to see the evidence by writing in - We are also part of the BPA Independent Appeals process if you are unhappy with an appeal decision and you can untimately have it taken to court if you wish - our website explains the legal basis for the charges so that's up to your daughter.
    The choice is your daughters to appeal or not, to request copies of photographs/CCTV - the charge is on hold whilst she does that (as long as within 14days as stated on the charge and notices).

    There is no such thing as a "BPA Independent Appeals Process". As for CCTV and photographs, they will only show the car. How are you going to identify the actual driver. Don't forget the contract is with the driver and not the RK. So unless you can identify the driver you are stymied.

    Don't forget to add that the BPA are a trade body rather than any form of regulatory autority. Also that the BPA Chief Executive Patrick Troy admitted to Parliament that the charges are not fines and that they have no legal standing.

    So you have photographs of everyone in the country and where they live so you know who to send the invoice to?

    You say you know who was driving, but how? Have you a data-base containing the the photogrpahs of everyone in this country? Unless you have that, you have no way if identifying individual people from images. If I showed you a photograph of people walking down a street, how many could you name?

    So Perky88 I would assume if you are monitoring CCTV in a public place your CCTV operator is SIA licenced to do so. Just in case this is an email I received on this point from the SIA.

    I can advise that if a parking company are using employees to monitor footage, the individuals would be required to be SIA licensed.

    However, you have enquired as to whether this entitles them to gain information from such departments as the DVLA, as we just deal with the licensing of individuals, I would advise for you to contact the DVLA as I am not sure of the circumstances in which they can give informationto 3rd party's.
