    With regard to the fraud issue - what the OP intends to do fulfils the criteria for the lay meaning of the word, but not that of the criminal offence. The phrase playing the system springs to mind.

    If the OP's doctor does provide them with a sick note, it shows exactly why the DWP use ATOS and not GP's to determine long term eligibility for ESA.

    Claiming the right benefit is surely not playing the system. And it would seem that a fair ATOS assessment would place the OP in the Work Related Activity Group at least.
  • Most dispensary drugs come in plastic bottles, even our methadone comes in plastic bottles. Our measures are plastic.

    Yes I am covered in cuts and bruises most of the time, doesn't stop me from getting boxes off of a shelf. Our shelves aren't that high and everything on the top shelf is specials which are always made up by the ACT and a pharmacists because they cost so much.

    Most damage I do is spill antibiotics when I'm reconstituting them or smashing a few bottles of medinol - don't worry it's dirt cheap at trade prices.
  • I am in that position too, TwoforTuesday. I became ill (heart condition and pituitary tumour, and was recovering from spinal surgery) and wasn't well enough to work for the past year so my GP provided me with fit notes which said this and I claimed ESA whilst having treatment. I have been taking advantage of the support they give you to do work related activities to study and do permitted voluntary work on days that I was well enough to. I let them know I was better and ready to go back on JSA in November and I was offered two jobs last month but have just been diagnosed with cancer :-( I will still be working and studying as much as I can though, so that when I have beaten the cancer I'm in a good position to get back to work.

    You do need to be unwell enough to be unable to be looking for work at the start of your claim for ESA, that's why you need a fit note. Indeed, if you have a fit note from your GP then you're not actually allowed to claim JSA as you have to be "actively seeking work" on JSA and having a fit note means that you are not well enough to do it. ESA is great though as it allows you to do work-related activity at your own pace, so that you can get back to work when you're well enough to.

    What about contribution based though?
    does he actually earn anything lol .. im not sure what he is actually employed as at the momenet to be honest i have not heard of him for years ..
    maybe he may be entitled to contribution based if he has made enough but as for esa or jsa im not really sure .. it depends if he is too ill to work and could get the sick note

    I don't know, because the supposed severity of the OP's condition would contradict the ability to work in a pharmacy, for their own safety and that of others. Something doesn't add up. ;)

    claiming a benefit because you would be sanctioned for claiming the benefit you should apply for is playing the system ..

    Not that I know of, but you will be covered by the Disability Discrimination Act and you can apply to Access to Work if you need any special equipment to help you in the workplace.

    Are you claiming DLA? If you're having fits regularly then you may be eligible for this.

    She may not pass the ATOS assessment, but she can appeal and still continue to receive ESA until the Tribunal date PROVIDING she continues to submit further sick notes.
    if the op manages to get a sick not from her dr then fair enough but what has changed in her condidion which makes her unable to work now that did not before she was "sacked" (if she does get sacked) for gross midconduct ..
