    Just because you say it's fraud doesn't make it so. There is a clear Work Capability Assessment and the OP would clearly meet the criteria for entitlement to ESA. The fact that she is working now, with a sympathetic employer who makes adjustments for her health condition doesn't change that.

    why is she trying to claim esa ?

    because she may be liable to sanction from jsa ...


    that is not a reason to claim esa

  • I've worked in this department for several years over 2 different stores and it's never really been an issue. I probably have about 10 seizures a month at work in various locations. I've bit through my tongue a couple of times but usually I'm ok after a seizure, one of the people in my department is a first aider who is also trained to administer midazolam (and i have a bottle of it bagged and labelled in the CD safe for me). If I'm out of it they'll call my dad to take me home, if i'm alright I go and have a cup of tea and return to my work station.

    Now bearing in mind you don't think someone like me should be doing my job what jobs do you suggest I do? (don't say office work, i have a talent for breaking electronics, see above). I can't work in front of a screen for long periods, can't really work in a busy environment, nothing with strobe lights or smoky atmospheres. The job I have is actually perfect for someone with epilepsy and I love doing it.

    Hopefully her GP will ask what has changed with your condition as opposed to not having ajob that means you are no longer able to work.

    Saying that this is all hypothetical and she hopefully won't loose her job and credit to her for working up till now.

    Employment and Support Allowance does still aim to get people back into work with support from pathways providers. If having a FIT note meant that you were not allowed to look for any work then it would make the aim of getting back into work impossible.

    I feel strongly about this because I'm in the same situation. I have a long term health problem that will never get better. I worked for almost 20 years despite it, where most others would have given up. It means I am entitled to ESA and I am claiming it. However it doesn't mean that I have given up on ever finding work again.

    Let's take an extreme hypothetical situation - If Professor Stephen Hawking were to lose his job, he'd clearly be entitled to ESA. Would anyone suggest it was benefit fraud for him not to claim JSA instead because he was able to work despite his severe health problems?
  • I think my GP is likely to be sympathetic, she's always let me decide which drugs I want to try again and let me stop treatment with one of them because i didn't like it.

    Is there a benefit for people who will have problems getting a job because they have a health condition and need adjustments?

    I just don't think you are safe to be amongst drugs,( meaning you may spill and contamunate) glass bottles and such items. If you have that many fits you must be breaking bottles etc all the time and be covered in bruises and cuts when you fall. I note you knock over shelves. I have no idea of what jobs you are capable of.

    i really hope you do not lose your job over your discount card because it seems you have the pefect job for you ..
    if you need help getting a job and resonable ajustments then speak to the job centre who will put you in touch with somewhere like shaw trust who help people with medical probs look for work

    Yes. In your case it is ESA.

    no he wouldn't because his savings would make him ineligble for benefits:rotfl:
