    Believe me i am making a fuss, i have emailed Apple, and letter sent to Cork today, I am not going to give up on this matter even though Customer relations had the cheek to tell me that when a phone is exchanged for a new one then the old one becomes the property of Apple, LOL

    The annoying bit is that they refuse to expedite it, or take it further as it is a legal matter, and that everything must be done through the police, although i got the distinct feeling that now the police have been told it may be destroyed, that might be the end of it from a police point of view.

    The phone may indeed no longer exist as a complete assembled unit ("destroyed" is slightly misleading), but its working parts will have been stocked by Apple for manufacturing refurbished phones. Although Apple will almost certainly have no way of identifying the parts from your phone, they should at least compensate you for taking those parts from which it is now benefiting. Reasonable compensation would be a replacement phone.

    Just had yet another conversation with Apple, this timne from Executive Relations, so its now been escalated further.

    I have so far spent over 4 hours on the phone, both with apple and the police, and slowly getting stressed out with the whole situation, next time i think i will stick with nokia, never had a problem when having to deal with nokia, lol

    Just had call from Vodaphone to an email that i sent to their CEO Guy Lawrence.

    They are going to look into y account, and also contact Apple and see what is going on with my phone, Why couldnt this be done from a phone call, this is more like customer service you expect from company's.

    Well the ball is rolling so now have to wait what happens, hope it gets better........

    Well just had a call from Apple Executive Relations, wasnt promising, they dont know whats happened with the phone, and said they may never find it!!!!

    I said so if you cant find it then you will have to give a replacement, and the woman said NO.

    So i said you wont replace it even though you accepted stolen goods, she also said that if you take a phone into a Apple retail store, they have NO WAY of knowing if that phone was stolen, and that they only service the phone, and dont need the details of the person who takes the phone in.

    Think i am going to have to issue a small claims against apple by the looks of things, time to head over to the legal boards to find out how to do this.........

    Two things that Apple have told you conflict with each other:

    It appears that Apple are trying to pull the wool over your eyes to save themselves providing you with a replacement phone as a result of their incompetence. In light of their admission that they had the IMEI number on the blacklist from Vodafone, you should ask the police to investigate as a case of handling stolen goods. From what you've said, it sounds as if Apple did this knowingly which would constitute an offence under Section 22 of the Theft Act 1968. Don't assume that a large company like Apple has watertight procedures that are always followed; their employees are humans who can make mistakes.

    I mentioned about the imei number being on the blacklist, and the woman said I dont know where the senior tech advisor got this information from as we dont flag stolen phones.

    Did you make a note of the name of the person who told you that they had the IMEI number on a blacklist? The police will need this.
