Firstly may I just point out that all excess milage on the motability lease agreement is paid after the 3 years is up and the car is handed back.
So you haven't yet broken any lease agreement as you are still under 60k miles and 3 years isn't far away so you could even say you could end up under as driving habits may change in the next 12 or so months.
So there is everyones argument out the window who are saying that he's void his warranty because he's broken his lease agreement.
If I go and lease a car tomorrow the lease agreement has nothing to do with the manufacturers warranty which in this case is for a brand new car 3 years minimum.
To caspercaz inform Motability of the situation and obtain a copy of the manufacturers warranty for new cars. Read through it and if you see northing about milage take it to the dealership and ask to see the manager and state your case. If all else fails put pressure on Motability to sort out as they are one of the biggest single car buyers in Britain and trust me they exercise that power on a daily basis.
If they won't help you in your case seek legal advice.0 -
42 thou cannot be out of manufacturers warranty for a 2 year old car, the dealer should just do the work under warrenty, which is usaly 100k or above (with correct milage sevicing done)0

As I explained my severley disabled son requires transport to school which is 28 mile round trip x2 a day. Sometimes I just need to drive around to calm him down. He requires 2.1 support and has also severe epilepsy so we have lots of appointments to attend,sometimes we need to make several attempts at journeys due to how he is behaving and wait until it is safe and he is happy. Thank you to the majority who have understood. I have a reply from motabilty confirming it is over 3 years so I will be chasing Nissan up and get them both to contact the dealer. Many many thanks for all advice.0

you don't say the model of you car.
How often is it serviced? Once a year/twice a year? You only say per motability T&C's which is? Have you been checking fluid levels yourself?
At 42K over 2 years if it has only been serviced twice then I suspect that it has breeched the manufactures warranty. Most cars need to be serviced approx every 8-12K miles.
If we take the middle ground of say 10K a year. It should have been serviced 4 times in the last two years. If it is every 12K it should have been serviced 3 times. Can you confirm how many times the car has been serviced.
Engines can last a very long time. My husband had D reg nissan sunny and when he got rid of it it had approx 150K on the clock. My S reg Daewoo has 87K on the clock. And since I have had (had 18K on the clock)has been serviced by a garage once in Dec 2009. My husband use to do it before he become disabled.
I think it all hinges on the service schedule of motability and service schedule of the manufacture as well as fluid levels being checked by the owner.

I wouldn't be wasting my time with the dealership. Phone motability direct. Also you don't have to keep returning to the dealership who supplied the car - you can go to another as long as its the same make.0

Is there no transport provided for your son to attend school?
It is normal for transport to be provided for children attending Special Schools, this may be a mini-bus or a taxi depending on the child's needs and would save you so much travelling, time and energy every day.
Besides the driver additional support would be in-place to meet your son's needs.0 -
Next time round it might be worth thinking of buying the car insteat of the contract hire .No issues with the millage but the down side you liable for costs .0

Well the thing is I did not dredge up this thread. I replied as it was within the top 5 or so of threads yesterday when I looked.
I did not even look at the date as I thought it was newish thread.
I know this is a slowish moving board to compared to the rest on the forum.
But find it strange that the thread re-appeared out of no where.
