How much mileage has the car done?

Whats you mileage. A car wouldnt normally blow up if maintained properly especially 2 years old. Cars if looked after can do well over 80k miles some a lot more

If the limit is 20k per annum which is very high anyway then I wonder if you breached there terms.

I find it bad enough affording to run a car on 2-3k per year especially given price of fuel now

th OP's reluctance to say how many miles is strange.
even if it were 2000 over the yearly 20, 00 it would equate to over 60 miles a day, 7 days a week, 52 weeks a year.
thats a lot of driving!

Regardless of Motability annual mileage limit and excess milage fees get onto the manufacturers website and check exactly what their own warranty for their cars state with regards to mileage each year.


For example Vauxhall now offer a standard 'Lifetime' warranty or 100k miles on new Vauxhall cars for the first owner whichever is reached first.

So if I did 50k in two years and my engine blew, unless in their T&C it specifically states x amounts of miles per year as a limit I would expect that if the car had been serviced by a Vauxhall dealer at the required service intervals stated by them and you haven't been neglecting the car I.E not putting enough oil or coolant in and letting it run dangerously low which has caused the engine to damage then I would expect them to foot the bill and fix it.


Regardless of the situation with mileage I wouldn't expect a two year old car's engine to fail regardless of 'high milage' I've seen cars still running with 310k on the clock that are 9 years old and still going strong.

Also isn't the motability scheme just a glorified lease scheme? So technically they are responsible for the car so unless you specifically have caused the fault I.E neglecting to check oil is correctly topped up then its their problem not yours and you shouldn't be asked to pay for it regardless of going over the stated milage? Because lets face it cars are made to be driven round and incur milage.

Yes its a lease but it does have terms and if you break those terms your lease could be void

Still Op doesn't state how much miles they do, and if it does high mileage then a service will need doing more than usually annual check

I agree a 2 year old car shouldn't do this unless neglected

5k for damage is a lot thats major fault

The problem isn't with motability, in the paperwork that the OP signed there would be a clause specifying that the warranty is null and void if the car is used for more than 20k miles per year. The OP was happy to accept these terms at the beginning of the agreement and should have been more careful with using the car in order to keep to these terms, expecting someone to travel 54 miles or less every day is hardly excessive.

Jen from the example I have provided with regards to a Vauxhall car on the scheme. So if I did over the 20k allowance and say for example did 22k a year 2k more than allowed on my lease terms, for which I pay 5p per mile over the 20k allowed again under my lease terms. However my new shiney vauxhall car has a 100k milage allowance for the warranty for the length of time I own it

So two years in I've done 44k and because my lease terms state that if I go over 20k a year I pay for the miles over I void my Vauxhall warranty? I don't think so. Vauxhall repair my car and if I then Exceed 60k at the end of my agreement I must pay for the excess milage over at 5p a mile to my lease agreement holders, which in this case is Motability.

So say I end up doing 66k at the end of my agreement. 6000 x 0.05p a mile = £300.

Just because you go over your allowed mileage on your lease agreement and incur a cost per mile doesn't mean you automatically void your manufacturers warranty which is standard atleast 3 years for new cars from date of delivery.

My advice is go and check your manufacturers standard warranty for new cars and see if there is anything stated with regards to annual milage limits.
