For the offence of obstruction to have been committed, they should also have to prove that, not only were the vehicles speeding, but that Mr Thompson KNEW they were speeding (ie there was intent on the part of Mr Thompson). There is not a chance that they could prove either of those.

One would hope if this ever gets to the Lords this point will be argued and they will agree with you, However, Darling said this
"The gist of the offence to my mind lies in the intention with which the thing is done."
He went on to convict Stevens in that case because the cars being warned were speeding (according to the police) and so they decided it was Stevens intent to prevent the detection of a crime. There appears to have been no evidence other than the say so of the officers that they were speeding. It seems to me they didn't "prove" they were speeding in Betts v Stevens or that Steven's knew they were speeding, but merely took the word/opinion of the officers to show that they were. They then decided that it was Steven's intent......

But we don't have the transcript or the full judgment of "Steven's" to look at.

yep but this is the exception rather then the norm.

Yes ive gone to fast in the past and probably will do again in the future and should i get caught then ill have to pay the penalty but im never going to condone speeding just the same as i wont condone burglary and other crimes too.

you may disagree but it does all boil down to speeding = breaking the law.

that's it. There is nothing else.

You should also look up "Notso" on google, and in Notso it's not a human manning a mobile camera making a mistake it's a calibrated camera, calibrated innaccurately, with regards to lines on the road and or flash intervals, and the flash interval cannot easily be challenged by the normal man. Who knows how much this goes on! That's the reason I slow down to 20 - 25mph to go past a 30mph Gatso, I don't want the hassle of fighting a case. I think all the people who go past cameras at the speed limit or 1mph/2mph below the limit are idiots.

You are (wilfully) missing the point! It doesn't matter what you think.

The ruling (in a higher court than magistrates, with a CPS appeal refused) is that unless the police can prove other drivers were speeding & were influenced by his actions then there is no case to answer... end of!

Just a minor point but I saw no reference to an influence being required for a conviction.

There is absolutely no way that anyone could ever prove that the specific vehicles that he flashed at were speeding and that he knew they were. It's not possible. It was a simple error by the Magistrates.

No one except the court of Betts v Stevens, however, without the full judgment of *that* case, we cannot really assume either way what is and is not possible.

If these stop people from speeding, how is that a flaw?

You may scoff at those who advise staying within the limits, but it is inescapable logic that if they don't speed they have nothing to worry about.

The speed at which it takes drivers to receive their NIPs is irrelevant; they get caught, get fined and have been punished for their crime.

However, you quite falteringly sidestepped the question; what is the alternative punishment for speeding drivers?

Please read it again & this time try to see the point! I don't expect you to agree but at least take your blinkers off & read it properly!

Sounds to me like this guy who got fined is a bit thick.

Why would anybody flash a warning to a vehicle that is speeding in any case? Just let them get caught and get the menaces off the road, not warn them so they just continue on their merry little way driving as they only see fit with no consideration for anybody else.

    The tool.

Is there no such thing as fraternity with fellow motorists?

Why would you let other motorists fall foul of the extra tax collecting machinery if you could help them? Or are you one of the Holy Joes that never speeds? ;)

Sounds like you're one of the 30Mph in a 50 zone and im not going any faster brigade ! that cause raised tempers in the cars behind you...

The tool. This your new nickname then ? :rotfl:[/QUOTE]

I personally flash oncoming drivers to warn them of any local speed traps, when you drive for a living as I do its nice to get advanced warning of the scamera vans.

Without my licence I would'nt have a job and probably a house as where I live we have no public transport so couldnt work.

I can honestly say that I watch my speed very closely for the said reason and have always had a clean licence, so why should'nt I give warning to others who might be in the same situation as myself ?
You may click thanks if you found my advice useful
