  • Just say, I noted the price on the shelf was £X. and when I just checked this is priced differently, can you just come with me to re check the price?

That way you don't have to mention the refund policy, you get to go with the CS and point out their mistake, then you can say in an innocent voice - 'oh, that means I've been overcharged doesn't it'

9 times out of 10 they agree!

I had a quite interesting one this morning.

Went in to collect my long awaited (well, since monday) phone R&R. CS lady looks like dragon. Or possibly my old headmistress. Quite scary anyway.

Old lady in front of me has been overcharged for some fruit that were put through as wrong product (not that I was evesdropping!) and is given R&R immediately.

Old lady asks why she has been given £3 back... CS 'dragon' explains policy in full.

Tell CS my sad story of woe who offers that 'next time find me, I'll sort the refunds out for you."

CS gets manager who comes to authorise it. Just casually chatting about the policy with him. Some interesting little snippets:-

"...you shouldn't have to demand it. Our policy is to give a full refund, not just the difference... It's not so much a legal thing as a respecting our customers thing... I really have no idea why they didn't just give you the refund in the first place...

I AM SO SORRY YOU HAVE HAD TO GO THROUGH ALL THIS"

not at all, Mr T, thank you for my free phone! And ms CS 'dragon', you might just be my new best friend!

    "So basic run down

SEL expired or not is and Invitation To Treat

you taking products to the till is The OFFER to purchase the goods at the price you were Invited to treat at.

Till operator selling you the goods is and acceptance of The OFFER.

Hence contract concluded. Item Miss priced Tescos policy comes into force."

Strictly legally speaking I do not agree with the analysis.
Either the till operator scanning the goods and offering at a (higher) different price could be construed as a COUNTER-OFFER, thus the contract is concluded when you agree to pay the amount offered.
Or, and I think more likely, the parties were never ad idem (of the same mind) and accordingly agreement could not have been reached (that is you thought you were buying at one price and the seller thinks they are allowing purchase at another).
Having said that CS are unlikely to know all of this and it is always worth a try.

I have no idea where this attempt at avoiding full refunds because of out of date SEL originated but I can state that as staff we are instructed to check SEL for expired dates as they are illegal and the company can be fined by TS for displaying them. Anyone who buys an item where the SEL is out of date has been mislead and is entitled to a full r&r; this is not open to debate at cs, its company policy pure and simple. At night after a change of promotion they always miss some SEL and I have to pass this on to fmc as technicaly we are not allowed to remove SEL, but the number of times they ignore these reports is unbelievable and it can be several days before they act.

In 2 Extra stores in the S Wales area today I have spotted various staff running around with the misprice list off of this forum. Needless to say all prices had been fixed.

Anyone else come across this today?

I thought it was a version or a issue number...ie, a barcode with a 5 on the end would be overridden at the tills by a barcode with a 6 at the end......and so on.

No, it is a check digit. There is a complicated bit of math mixed up in a barcode.

The version number you refer to is at the end of the string of numbers on the bottom of the SEL.
Who or what was I before you came in to my life
    I am not sure

please dont shout, but surely it would make more sense not to have someone 'update' the misprices in a great big list every day then, cos you're only making it easier for the staff at tesco to check everything

So is the version number of the SEL the very last number or numbers at the bottom of the SEL. I assume if it ends 06 and another SEL ends 07 then the 07 is the latest price.

Hi Constantine. Are you allowed to give us further info on the numbers on the SEL's & barcodes, & what to look out for.
(Quite understand if you can't do that)
