Have gone for up to five of the same product, but only ever 2 or 3 different types depending on value. I try to keep it under £20 each time unless it's one bigger item so that it doesn't need authorisation.

I am also going to go down this route as my local trading standards office have advised me this is a cast iron case of over charging and misrepresentation.

The bottom line is that each of these Xbox R&R's are completely legitimate but by taking the "get stuffed stance" Tesco is hoping you will all go away, enjoy your new Xbox and simply accept the price you paid - but why should you?

If you feel so strongly about this and believe like many that Tesco are guilty of misleading their customers (and happy to overcharge when the less savvy shoppers do not realise) then you should make you feelings known to Tesco and contact trading standards.

Remember how I said that R&R can get emotive???

I'm sorry but you are on a one-way ticket to Frustrationville.

It was a tenuous mis-price - from a 'reasonable' point of view anyone going for this is on shaky ground.

Head Office will not budge on this one.

I doubt Trading Standards are going to be interested.

If you don't want it, get a refund Dude

Well done to all of you for taking this further, so much rubbish gets posted on here about taking Tesco to court etc and nobody ever goes further with their complain, I am sure it is for reason that Tesco HO have started to turn people away and ignore their won company policy.

    Wlfc1 - you're a star - but...

    ...and it's a big but...

...Trading Standards are simply not interested in R&R period.

    Full stop.

The problem here - as His Dudeness keeps saying - is that the current XBOX mis-price is not clear-cut to the average Joe.

So if TS aren't interested in straight-forward mis-prices, how on earth are they going to show any interest in the current polova?

I'm a bit confused about addresses/phone numbers for complaints about refunds(or lack of them!).

I phoned the 0800 number given at the beginning of the thread (Dundee I think?). I sent my written follow up to Delamare Road, Cheshunt. Now I'm not sure what number to call when I want to chase them up - should I use the same 0800 number or is there another one ? My complaint was just addressed to Customer Services not the Chairman.

    Any advice would be appreciated.

Dude, I've got to disagree with you on this. TS is very interested in the falsely advertised saving Tesco displayed and the time it took Tesco to rectify it. If you get a nice TS officer, they will also put pressure on Tesco to honour the policy and refund the customer. Most of the time, however, they will investigate Tesco and take action if necessary. I would say it's well worth a complaint to TS, as this particular issue is worse than your normal, run of the mill misprice. It's blatant false advertising which Tesco became aware of pretty quickly, yet did not act fast enough to resolve. I don't think Tesco can claim a defence of "Due Diligence" on this one. The more people who report Tesco for the Xbox 360 misleading savings advert, the more likely TS is to follow through and actually take Tesco to court for it.

    Tesco fined for misleading ads

    This is Money
23 November 2005 SUPERMARKET giant Tesco has been slapped with a £4,600 fine after it admitted signs promoting wine deals mislead consumers.
    pixel.gif

A trading standards investigation found stores in Truro and St Austell in Cornwall claimed that it was cheaper for customers to buy a case of wine rather than six individual bottles. The signs, stating 'Case Deal. Always cheaper than six single bottles' and 'Six for less', were found misleading because in the case of four brands it was cheaper to buy the bottles individually.

The retailer pleaded guilty at Liskeard Magistrates' Court in Cornwall to two counts of giving misleading price indications and asked for a further 15 offences to be taken into consideration, Cornwall County Council said. Magistrates fined Tesco £2,300 for each count and ordered the company to pay almost £4,000 in costs.

Dave Phillips, head of Cornwall trading standards, which brought the prosecution, said: 'A company like Tesco, with its sophisticated IT and checking systems, should be capable of getting its prices right. The magistrates have given their judgment and this particular matter is now closed. 'However, we will be working with colleagues in Hertfordshire, who interface with Tesco's head office on behalf of all trading standards authorities, to ensure that a similar lack of control doesn't happen again.'

A Tesco spokesman said: 'We reduce prices on thousands of products each week to ensure the best value for our customers. Unfortunately, on this occasion we didn't adjust the case price to reflect the new lower single bottle price. 'We have reviewed our process and rebriefed staff to make sure this doesn't happen again.'

Consumer group Which? accused leading supermarket brands of misleading consumers over special offers in August. It identified a host of examples where offers promise substantial savings but deliver only pennies. Which? also found that buying in bulk did not always give better value as most customers assume. Tesco's Classic coffee cost the equivalent of 88p per 100g in small jars, while the price in bigger jars was £1.10 per 100g.

Some time ago, I complained to TS about one of my locals. TS sent an officer to the store to investigate. This lead to massive back-tracking from the manager, who apologised profusely. TS told him that they would be paying him regular visits over the next few months. The TS who dealt with it kept me informed the whole time.

Brother in law in there last night, 2 console games and Stell Artois, so this store is by no means r&r proof, there is still an r&r in there apparently (but he left it)

don't worry. the net is closing in on kevin kelly. he's got a track record of picking fights with people. not a nice person by all accounts

did you know, he used to work for sainsburys and there's an interesting story about that. more to follow
Please keep it to yourself. This is not a place for personal attacks on named Tesco employees. "Interesting stories" are often defamatory and unsubstansiated and can put the entire site in jeopardy.
I take it you're a regular with a second ID? Seems very unusual for a first post otherwise.
    Can I help?

Nope we are not joking! Tesco refund the equivalent price you have paid for your item as a bribe, to stop you (hopefully) from reporting ALL their overcharges to Trading Standards.

They cannot ignore statutory rights even if they have refunded the equivalent of the price. You have still legitimately bought the item and have a valid receipt for statutory rights returns only. I bet if I took my free Console back if it broke down in the first year I might attract some frowns from CS desk staff when they see the item was fully refunded, BUT there would be nothing they could do about it except replace it (or even refund it again, if it were faulty, as per my statutory rights!).

HTH, now get yourselves down there (well maybe in the morning!).

Just want to say, i did this, with the r&r xbox which on setting it up constantly froze, took it back 2 days later, was a lot of ooohing and ahhing but i stood my ground with my stat rights and got a brand new one a week later.
