The OP and TS are right , and wrong !
Play.com act as brokers in any Playtrade transaction. As such they are ultimately responsible for the financial side of the trade and thus must reimburse the OP. It could even be seen that they are responsible for advertising counterfeit goods (at a stretch).
HOWEVER
As with much of the internet, the whole Playtrade system operates via a large degree of trust and good faith. I am sure that Play.com have written in the T&Cs something about items being sold through Playtrade being genuine goods, not copies or fakes. What else can they do?
What is being missed here is that Play.com may well end up losing out financially for a problem not of their making, if they have already paid the money to the Playtrader. It is a bit unfair to libel them as well.
OP, you are getting a full refund, Play.com are blacklisting the fraudster and, if they have any sense, will be reporting him to the relevant authorities for further investigation. It sounds like a good result all round to me.0 -

Semantics are very important in communication. In the case of the OP they are right and wrong in what they have as the thread title. As the game was purchased using the play.com website then 'technically' speaking the OP is correct to say that play has allowed the sale of a pirated game through their site and using their name. The other posters are correct though in that the OP bought the game from a 3rd party with whom Play have a contract (t&cs for being a seller) so 'technically' the OP has a gripe with "madgames" and not Play.
I'm not requesting that you change your thread title but personally I would to be on the safe side as I know someone (in person, not through an a knows b who knows c kinda way) who received a solicitors letter threatening them with being sued for defamation due to a comment posted online. The person who made the comment felt they were entitled to their opinion but in the eyes of the law what they did was wrong. I wouldn't want to see you getting sued for libel as that would be a horrible start to the New Year.0 -

finally! a sensible response to this. If people have a problem with the thread title then they should say their piece, report the thread if they think it's violated MSE posting rules, and then leave. I don't see the point in winding up the OP :undecided0 -
