The law would be on your side if the seller is a commercial organisation. Therefore DSR comes into force as long as it was not in an auction.
If it was a private sale, then I am afraid TS are wrong, we have numerous mentions from wannabe Australian farmers about this.

The money you have paid to Play has been sent to the private seller (madgames I believe), therefore apart from a small fee that play will charge the seller for handling the financial transaction and allowing them to advertise on their site they are not involved with the product. Therefore I agree with the others that the title should be changed as you are basically accusing Play the company of distributing fake merchandise when that is clearly not the case!
From a side point of view, you've got the game, you're getting a full refund and the seller is being blacklisted so I think Play have treated you correctly and fairly and deserve more than to be accused of being a trafficker in forged merchandise!This is a system account and does not represent a real person. I wont have the game as trading standards have asked for it. No difference to me anyhow as it was for a DSI and the DSI wont play fake games. So I am not benefitting in any way from this inconvenience. When I get my refund I will pop along to game and buy it from them.0

If the board believe It is wrong they may remove the whole thread.
And you were quick enough to post bits of their site that tried to make out it was a private seller etc, not so quick to point out they DO acccept liability.0
