Last august, I took out my first phone contract with vodafone (For a blackberry curve). I went into the Worthing shop with my dad (who was paying for it), we was asked to sit down to arrange the contract.
All was fine and simple, and as a seeming bonus, the salesman said that I would be given a free months insurance, but not to worry about cancelling as it would cancel itself after the first month. Needless to say, it never cancelled. My dad saw the price being £7 over each month, but never compared his statements to see it was always the same price (I got the blame for going over my contract). I wouldve been able to see that I wasn't going over the contract had I been able to log into the site - I was always instructed that the site wasn't working and to check in a couple of days. Never believe what they tell you, been paying £7 a month because of the salesman's lies!!!0 -

Partially and you also have to share some blame as you never checked a bill.
Vodafone may have problems but in the 12 months you had the phone you never once tried to get the billing problem sorted? Why didn't you try and get the billing problem sorted out earlier? If I had online billing fail for more than a few days I'd be trying to call the compnay to find out why.
You can try complaining and you may get something back but iat most it's likely to be a few months credit.0 -

Vodaphone have logged a default against me for a phone that an ex took out before we even met. I was married and living at another address!! when the contract started, I have evidence of this. I didnt even know the mobile number when I got the debt collectors letter and it took a further 5 months to get details of the debt. As I had no idea what it was for. Once I had the mobile phone number, i got no where as I had no way of getting passed security as it wasnt my account. I hadnt set it up. I eventually did after contacting Vodaphone so many times I lost count.
I then have asked Vodaphone for a copy of the contract details and they said they have been destroyed and that they have no details. I satisfied the debt back in August last year as I didn’t want the debt collectors after me again. I eventually contacted my ex and he even offered to speak to Vodaphone to confirm it was his contract and not mine. No-one was interested at Vodaphone.
Frustrated I wrote to the CEO of Vodaphone he responded to say customer services would deal with it and then I had exactly the same answer, no records therefore you are responsible. They don’t have the records so therefore it’s me. All DD payments were made by my ex and paid from his bank account. It was just my address that he used once we had met as we were living together for a period. This is identity fraud, surely?!!
It has ruined my credit rating. Any suggestions as I feel totally let down, it’s like - tough from Vodaphone. I need to get a mortgage and its totally blackened my name. i didnt take the account out, I never signed for it. So how can a debt be logged against me for soemthing I never sign or took out?0 -

Heidi - I think its cleaer from Superherogirl's post that the phone wasn't in her name!Her ex took out the contract before they even met!
We are having problems with Vodaphone too and if we don't get a result when we call today we will be contacting you to resolve it.0 -

In order for the records to be destroyed it would mean the debt is over 6 years old as they are required by law to keep the records for up to 6 years.
If the debt was over 6 years ago it would have been statute barred (unless it was subject to CCJ)
I would guess that the debt was sold on but the problem you now have is that in paying the debt you have admitted liability for it unless you made it 100% clear in the payment to the collectors on the paperwork.It's not just about the money0 -

I did not take the contract out - its was in never in my name. I do not know how my name became attached to the account other than my address being on the debt collectors letter.
I was told the account was NOW in my name. But I have never seen a contract or taken the contract out. Why are the records destroyed? how can I prove my innocence when I have nothing. It would now appear that Vodafone legally cant destroy records when I have emails from Vodafone siting this as an excuse!?
It was never my account, never has been but my name has been used and Vodafone cant prove otherwise. It would appear that by paying the debt I have admitted liability? well i thought this better than getting a CCJ for a debt that was never mine and no-one is listening...at Vodafone0
