Can Credit Checks be done without permission

Hello All,

Last year I created a Jacamo Account (J.D Williams) I was going to order some clothes, something came up so didn't finish putting my order through. When I went back to finish my order I saw they had given me 'Credit' which I did not request, I placed an order and used the credit they had given me, and never paid them back, they sent many nasty letters which I used to reply to saying, "if you can provide a copy of the credit agreement I signed I would pay" eventually they sent me the agreement but of course it was not signed by me, So I never paid eventually they gave up asking for the money.

Now, a few days ago I placed an order with PremierMan which I found out after was also J.D Williams, so today I checked my credit report and blow and behold they ran a credit check on me, This time they used their brains and didn't give me credit.
I have read every last bit of small print on their website and cannot find anything anywhere saying they will run a credit check, or that it would be a credit account. This evening I called them and gave them hell for running a check without permission, the woman I spoke to said they ran a check because I applied for a credit account, I said that was complete nonsense and there was nothing on the website saying it was a credit account. Eventually she got bored arguing with me and said she couldn't help but offered to get their credit department to call me back.

I am wondering if it is legal to run a credit check without permission or at least stating somewhere that they will? Any advice will be greatly appreciated.

    This has happened to me before but with NEXT. They run a credit check and if you pass, they set you up a credit account otherwise the page forwards to a payment page for you to pay via credit card.

    Nowhere on the site was this made clear and I felt it was very misleading. It was however, in there terms and conditions small print, which is so long, you just would not read it all before placing an order online.

    So....I phoned the financial Ombudsman and logged my complaint as they ran a credit check etc and without explicitly telling me. I was only purchasiing £10 cufflinks!!

    I got a letter and phone call only days later apologising profusely and they gave me the item free of charge and promised to make it clearer to customers.

    So....my advice would be to have a good read of the T&C's on their site and give the financial ombudsman a ring and log your complaint. It is not on and they should be warning you that a credit check will take place before you order.

    You should read the Terms & Conditions of the account before clicking ‘Accept’ or ‘Decline’ to indicate whether you are happy to continue setting up a credit account. If you would prefer not to have a credit account as you are happy to pay in full by credit or debit card at the time of each order, then you should click decline at this point in the process. You will then be offered the opportunity to set up a non-credit account.

    Unless you make sure that you tick the decline box, then a credit account will be set up automatically.

    Ok not quite there still are you.. the first link i gave, the very first information on the page says they will do a credit check..
    Data Protection We will make searches about you at credit reference agencies who will supply us with credit information, as well as information from the Electoral Register. The agencies will record details of the search whether or not credit is granted.

    Both the credit searches and how to open a non credit account are both there, basically you should read the terms and conditions before you press accept..

    It states in the terms and conditions you will be credit checked its your responsibility to ensure you read them before you accept anything. So they havent done anything wrong to be honest.

    One other thing since you mention in the OP about not paying them last time is this.
    This information may also be used for debt tracing and the prevention of money laundering as well as the management of your account and also for our marketing. We may also use your information, including shopping habits, to open and run your credit account including payment recovery, fraud prevention and debtor tracing and for our marketing.

    Well I appreciate everyone saying it's 1st Line of t&c but that's not what shows on mine! I even printed it, what browsers are you using? I'm on internet explorer (latest version)
